DISCUSSION
The purpose of this Mayor and Council Communication (M&C) is to authorize execution of
Change Order No. 3 to City Secretary Contract No. 63916, with Woody Contractors, Inc.
On August 12, 2025 (M&C 25-0727), the City Council authorized a construction contract with
Woody Contractors, Inc. in the amount of $6,807,311.50 for the Water & Sanitary Sewer
Replacement Contract 2019, WSM-N project.
The contract was subsequently revised by two change orders as follows:
Change Order No. 1 with a net total of $0.00 was administratively authorized February 20, 2026,
and provided for crushed rock backfill due to groundwater encountered during installation of
the 24-inch water line on Felix Street. Change Order No. 2 with a net total of $86,250.00 was

administratively authorized April 13, 2026, for additional concrete flatwork on Hammond Street
in order to facilitate the pulverization and overlay process of the street subsequent to water
line installation.
This Change Order No. 3 will provide additional temporary asphalt pavement quantities to
facilitate drivability, as the original bid quantity was insufficient. The change order also includes
replacing the originally planned pulverization and overlay at Hemphill Street with mill and
overlay due to the existence of reinforced concrete subbase. In addition, it provides for the
removal and replacement of an existing 18-inch storm drain that was encountered in direct
conflict with the proposed water line.
It is the practice of the Water Department to appropriate its Capital Improvement Program
(CIP) plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as
projects commence, additional funding needs are identified, and to comply with bond
covenants.
Funding is available in the Transfer to Water/Sewer account of the Water and Sewer Fund for
the purpose of funding the Water/Sanitary Sewer Replacement's Contract 2019 WSM-N project
within the Water & Sewer Capital Projects Fund.

The Director of Finance certifies that funds are currently available in the Water & Sewer Fund,
and upon approval of the above recommendations and adoption of the attached
appropriation ordinance, funds will be available in the W&S Capital Projects Fund for the
Contract 2019 WSM-N project to support the execution of the change order. Prior to any expense
being incurred, the Water Department has the responsibility of verifying the availability of
funds.
