DISCUSSION The purpose of this Mayor and Council Communication (M&C) is to execute amendment No. 1 to City Secretary Contract No. 63720 with William J. On June 10, 2025, by M&C 25-0529 the City Council authorized a construction contract with William J. Schultz, Inc. dba Circle C Construction Company, in the amount of $6,669,650.00 for Large Diameter Pipe Bursting Contract ICAP project Part 2 (M-468). Change Order No. 1 primarily provides for open cut trench installations in lieu of trenchless pipe enlargement due to extremely hard rock material (which does not allow for bursting and 1 of 2 FORT WORTH. enlargement) that was encountered when pipe enlargement commenced. Furthermore, open cut necessitates new and increased pay item quantities for the following: Additional bypass pumping, seeding, bank stabilization for stream crossings native grass seeding, the removal and replacement of a 5 -foot reinforced concrete trail and by other than open cut installation across Watauga Road. It is the practice of the Water Department to appropriate its Capital Improvement Program plan throughout the Fiscal Year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Funding is available in the Transfer to Water/Sewer account of the Water and Sewer Fund for the purpose of funding the Large Diameter Pipe Bursting Contract ICAP, Part 2 (M-468) project. DISCUSSION 1 of 3 FORT WORTH. In March 2026, a leak was found near a joint where a tapping saddle was previously installed on the 84 -inch diameter pre -stressed concrete raw water line that provides service to Rolling Hills Water Treatment Plant, which was installed in 1972. Excavation of the leak revealed that the pipe defect could not be easily repaired and required the replacement of two 16 -foot -long joints. To complicate matters, accessing one of the joints for replacement required the removal of the existing medium voltage reinforced concrete duct bank, which provides electrical service to the ozonation system and blower building. It was necessary to repair the existing raw water pipeline and to reroute electrical conductors out of the duct bank to provide power to critical treatment processes while the repairs were taking place. The portion of the duct bank that was removed in order to perform the raw water pipeline repairs was reinstalled upon completion of the raw water pipeline repair work, and electrical conductors were reinstalled within the duct bank system. It was imperative that these repairs be completed prior to the summer demand season. Under an emergency authorization memorandum of March 17, 2026, William J. Schultz, Inc. dba Circle C Construction Company, (City Secretary Contract No. 64890) and Winston Electric, Inc. dba Acme Electric Company, (city Secretary Contract No. 64888) were engaged for repairs to the water mains. The total cost for both of these contracts was $920,324.30, which is fair and reasonable for the work performed. Upon ratification of these contracts, staff will close them out. Section 252.022 of the Local Government Code exempts from normal bidding requirements projects that are necessary to preserve or protect public health or safety of the municipality's residents and procurements that are necessary because of unforeseen damage to public machinery, equipment or property. It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Funding is budgeted in the Transfer to Water/Sewer account of the Water operating budget for the purpose of funding the Emergency temporary duct bank relocation for 84 -inch water line repair at RHWTP (ACME) and the EMER 84 -inch water line repair at RHWTP (Circle C) projects within the Water & Sewer Capital Projects Fund.
