WHEREAS, Chapter 35 of the City Code, "Water and Sewers", Article III, Division 4 entitled "Water Main Capacity Charges" provides for the adoption of Water Main Capacity charges by City Council to allow for developers and the City to recover cost incurred from installing water mains offsite of their development and to set forth the method and procedures for assessing reimbursements from subsequent developers wishing to connect to the offsite water mains; and WHEREAS, GBTM Sendera, LLC, hereinafter referred to as "Developer", is constructing a 16 -inch water main located at the intersection of Rancho Canyon Way and Sendera Ranch Blvd (City Project No. 104078); and WHEREAS, the City of Fort Worth Water Department is cost participating to upsize and extend the 16 -inch diameter pipe to a 30 -inch diameter pipe; and WHEREAS, in addition to upsizing the pipe diameter, the City of Fort Worth Water Department is extending the 30 -inch diameter pipe by an additional 3,285 linear feet, for a project total of 3,895 linear; and WHEREAS, the Developer is installing 610 linear feet of the Rancho Canyon Way 30 - inch diameter pipe, which is 15.66 percent of the total project, and the City is installing 3,285 linear feet, which is the remaining 84.34 percent of the total project. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. The City Council finds, in accordance with the Code of the City of Fort Worth (2015), as amended, Chapter 35 "Water and Sewers", Article III, Division 4, Sections 35-87 through 35-93, that the Developer has initiated construction of a 16 -inch water transmission main. Ordinance No. 26-28756 Page 1 of3 SECTION 2. The City Council finds that $2,144,640.92 is the total cost for the City to upsize the Developer initiated 16 -inch diameter water transmission main to 30 -inch diameter pipe. The total capacity of a 30 -inch diameter pipe is 20.76 million gallons per day (MGD). The net capacity of the new water main available to the City is 15.9 MGD because the Developer will utilize 4.86 MGD of total capacity in the new water main. Under the City Code, the City may establish a water main capacity charge for the difference between the net capacity of the new water main and the total capacity allocated to the Developer. The net capacity of the 30 -inch diameter pipe being constructed by the Developer is 15.9 MGD, and the Developer is constructing 610 linear feet of the total 3,895 linear feet of the project. Therefore, the cost per MGD for the City's percentage contribution to the project is $21,122.69. The net capacity of the 30 -inch diameter pipe being constructed by the City is 20.76 MGD, and the City is constructing 3,285 linear feet of 30 -inch diameter pipe. As such, the cost per MGD for the City's percentage contribution to the project is $87,128.62. Therefore, the total cost per MGD is $108,251.31 and is the Water Main Capacity Charge to be assessed if the plat meets the definition of "Other Development" as defined in Section 35-88 of the City Code. SECTION 3. The City Council further finds that the Water Main Capacity charge has been calculated in accordance with the requirements of the Water Main Capacity Charge Policy. This water main capacity charge will be reimbursed to the City of Fort Worth Water Department. The maximum reimbursable amount to the Water Department is $2,144,640.92. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. Adopt the attached ordinance to establish the water main capacity charge for the City's cost participation in a developer -initiated 30 -inch Northside IV water transmission main and extension (Rancho Canyon Way 30 -Inch Water Main), in accordance with Chapter 35, Water and Sewers, Article III, Division 4, Sections 35-87 through 35-93 of the City Code; and 2. Establish the boundary area for the water main to allow the Water Department to assess a reimbursement for the City pursuant to Section 35-93(c) of the City Code. DISCUSSION The purpose of this Mayor and Council Communication (M&C) is to authorize the establishment of a water main capacity charge for a developer -initiated 30 -inch Northside IV water transmission main extension (City Project No. 104078) near Rancho Canyon Way and Sendera Ranch Blvd. The Developer initiated this project. The City has cost participated in the project to oversize and extend the current 16 -inch approach water main to a 30 -inch approach water main. Under the Section 35-92 of the City Code, the City may establish a water main capacity charge for the difference between the net capacity of the new water main and the total capacity allocated to the Developer. The Developer is installing approximately 610 linear feet of 30 -inch water main to serve the Northside IV pressure plane and surrounding areas. The City of Fort Worth is extending the 30 -inch water main by 3285 linear feet. The total length of the project is 3895 linear feet. The Developer's installation of 610 linear feet of 30 -inch water main is 15.66% of the total pipe to be installed. The City's installation is 84.34% of the total pipe to be installed. 1 of 3 FORT WORTH. The net capacity for a 30 -inch water main is 20.76 million gallons per day (MGD). Because the Developer will utilize 4.86 MGD of total capacity, the City's total available capacity for the upsized portion will be 15.9 MGD. The City's qualified costs used to establish this water main capacity charge are outlined below: Description City City Total Cost Project Secretary Number Contract Water Line 104078 58230 $1,979,287.44 Construction Engineering 104078 58225 $165,353.48 Costs Available Percentage MGD Cost Per MGD 30 -inch Oversizing 15.9 15.66% $21,122.69 from 16 inch 30 -inch 20.76 84.34% $87,128.62 Extension Total $2,144,640.92 $108,251.31 The water main capacity charge for the 30 -inch Northside IV water transmission main extension is $108,251.31 per million gallons per day (MGD) in accordance with City Code Section 35-92. The water main capacity charge collected will reimburse the Fort Worth Water Department. The City's collection of this charge will end when the City's development costs are fully reimbursed. The boundary area, as shown on Exhibit A, is determined for the purpose of assessment review. The boundary is used as a guideline, not as a definitive boundary for service area due to the possibility of varying lot sizes that may be proposed. If a plat meets the definition of "other development" stated in Section 35-88 of the City Code, then the plat will be assessed the water main capacity charge even though the plat may be located adjacent to, within, and/or outside the boundary area. The adoption of this charge is in accordance with Chapter 35, Water and Sewers, Article III, Division 4, Water Main Capacity Charges. The water main capacity charge boundary is located in Council District 10 and ETJ. This M&C does not request approval of a contract with a business entity. 2 of 3 FORT WORTH. FISCAL INFORMATION/CERTIFICATION The Director of Finance certifies that upon approval of the above recommendations and establishment of the charge, funds will be deposited into the Water & Sewer Fund. The Water Department (and Financial Management Services) is responsible for the collection and deposit of funds due to the City. SUBMITTED FOR CITY MANAGER'S OFFICE BY: Jesica L.
