Home My WebLink About26-6391 - City Council - ResolutionRESOLUTION 26-6391 A RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT NO. 3 TO AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE REVISED AMOUNT OF $25,995,225.00 WITH CITY PARTICIPATION IN THE FORM OF TRANSPORTATION DEVELOPMENT CREDITS IN THE AMOUNT OF 5,184,841 PLUS ANY COST OVERRUNS FOR THE CONSTRUCTION OF THE VA; MEANDERING ROAD / LT JG BARNETT ROAD PROJECT WHEREAS, on October 13, 2020, the City of Fort Worth and the Texas Department of Transportation ("TxDOT") entered into a Local Project Advance Funding Agreement ("AFA") for the reconstruction of the VA; Meandering Road / LTJG Barnett Road project in the amount of $19,066,865 with federal participation in the amount of $18,284,010 and city participation in the form of Transportation Development Credits in the amount of 3,463,963 (M&C 20-0722, Resolution No. 5283-09-2020; City Secretary Contract No. 55206; CSJ #0902-90-046 and #0902- 90-172); and WHEREAS, on May 2, 2024, the City and TxDOT executed Amendment No. 1 to the Advance Funding Agreement to increase Project Total from $19,066,865 to $22,207,642 with federal participation in the amount of $21,248,208 and city participation in the form of Transportation Development Credits in the amount of 4,249,641 (City Secretary Contract No. 55206-1, Resolution No. 5870-01-2024, M&C 24-0038); and WHEREAS, on January 27, 2026, the City and TxDOT executed Amendment No. 2 to the Advance Funding Agreement to increase Project Total from $22,207,642 to $27,228,605 with federal participation in the amount of $25,924,208 and city participation in the form of Transportation Development Credits in the amount of 5,184,842 (City Secretary Contract No. 55206-2, Resolution No. 6147-08-2025, M&C 25-0785); and WHEREAS, it has become necessary to amend the Advance Funding Agreement to decrease the Project Total to $25,995,225, federal participation in the amount of $25,924,208, state participation in the amount of $71,017 and city participation in the form of Transportation Development Credits in the amount of 5,184,841. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: The City Council authorizes the City Manager or Assistant City Manager to execute Amendment No. 3 to the Advance Funding Agreement with the Texas Department of Transportation for the VA; Meandering Road / LT JG Barnett Road project (City Secretary No. 55206; CSJ #0902-90-046 and #0902-90-172) for a revised amount of $25,995,225 with city participation in the form of Regional Transportation Development Credits in the amount of 5,184,841, plus any cost overruns. Adopt the attached resolution authorizing execution of Amendment No. 3 to the Advance Funding Agreement with the Texas Department of Transportation (City Secretary Contract No. 55206; CSJ # 0902-90-046 and #0902-90-172) for the Meandering Road project (City Project No. 100873) to decrease the project amount to $25,995,225.00 with City participation in the Form of Regional Transportation Development Credits in the amount of 5,184,841, plus cost overruns; and 2. Adopt the attached appropriation ordinance decreasing estimated receipts and appropriations in the Grants Capital Project Other Fund, in the amount of 1, subject to the receipt of the grant in the form of Transportation Development Credits, for the purpose of funding the Meandering Road project (City Project No. 100873). DISCUSSION The purpose of this Mayor and Council Communication (M&C) is to adopt a resolution authorizing the execution of Amendment No. 3 to the Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) (City Secretary Contract No. 55206; CSJ # 0902-90-046 and # 0902-90-172), for the Meandering Road project (City Project No. 100873) to decrease Total Advance Funding Agreement Amount by $1,233,380.00 from $27,228,605.00 (Amendment No. 2) to $25,995,225.00 (Amendment No. 3). AFA Amendment No. 3 does not change the Federal participation but decreases the State participation (Indirect State Cost) in the amount of $1,233,380.00 and decreases the City participation in the form of Regional Transportation Development Credits (TDCs) by the amount of 1 from 5,184,842 to 5,184,841. 2 of 4 The City Council approved an AFA with TxDOT in the amount of $19,066,865.00 and city participation in the form of Transportation Development Credits in the amount of 3,463,963 on October 13, 2020 (M&C 20-0722) for engineering, right-of-way (ROW) acquisition, and construction of the Meandering Road project, including Meandering Road from State Highway (SH) 183 to Anahuac Avenue in the Cities of River Oaks and Fort Worth and LT JG Barnett Road from Meandering Road to the Naval Air Station Joint Reserve Base (NASJRB) East Gate in Fort Worth. Amendment No. 1 to the AFA (M&C 24-0038) was for additional engineering, ROW, utility relocation, and construction costs for the project. Additional federal funds in the amount of $2,964,198.00, additional State participation in the amount of $176,579.00 and additional City contribution in the form of TDCs in the amount of 785,678 were approved. Amendment No. 2 (M&C 25-0785) was for additional engineering, ROW, utility relocation, and construction costs for the project. Additional federal funds in the amount of $4,676,000.00 were approved by North Central Texas Council of Governments (NCTCOG) RTC Action on June 10, 2025, and the city contribution in the form of TDCs increased to 5,184,842. Amendment No. 3 has become necessary to amend AFA to revise the Indirect State Costs due to the TxDOT FY 2026 Indirect State Costs rate and new calculation method. The new Indirect State Cost is $71,017.00 and TxDOT absorbed these additional indirect costs for providing statewide support services to this federally funded project. The State Indirect Costs will not be appropriated in our finance system. The City's local match using TDCs is decreasing to 5,184,841 which are appropriated and tracked as a non-spendable item in the Grants Capital Project Other Fund. FISCAL INFORMATION/CERTIFICATION The Director of Finance certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, in the Grants Cap Projects Federal Fund. The Transportation and Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Financial Management Services Department has the responsibility to validate the availability of funds. This is a State Advance Fund Agreement.
