AMENDMENT NO. 1 TO CITY SECRETARY CONTRACT NO.41182
ECONOMIC DEVELOPMENT PROGRAM AGREEMENT
BETWEEN CITY OF FORT WORTH AND ROBERT G.MUCKLEROY
This AMENDMENT NO. 1 TO ECONOMIC DEVELOPMENT PROGRAM
AGREEMENT ("Amendment") is made and entered into by and between the CITY
OF FORT WORTH ("City"), a home rule municipal corporation organized under the
laws of the State of Texas, and ROBERT G. MUCKLEROY ("Developer"), an
individual.
The following introductory provisions are true and correct and for the basis of this
Amendment:
A. As of November 15, 2010 the City and Developer entered into that certain
Economic Development Program Agreement on file in the City Secretary's Office as City
Secretary Contract No. 41182 (the "Agreement"). Under the Agreement, Developer
agreed, among other things, to cause construction of a parole office facility (the
"Development") on certain real property in the City, as more specifically set forth in the
Agreement. In return, the City agreed to make a series of up to ten (10) Economic
Development Program Grants equivalent to up to one hundred percent (100%) of the
Development Real Property Tax Revenues (as defined in the Agreement) received by the
City, not to exceed an aggregate of Ninety Four Thousand Three Hundred Seventy Four
and No/100 Dollars($94,374.00), so long as the Development was completed by not later
than May 1,2011.
B. Due to unforeseen delays in constructing the Development, the City and
Developer now wish to amend the Agreement in order to extend the deadline by which
the Development must be completed.
NOW, THEREFORE, for good and valuable consideration, the receipt and
adequacy of which are hereby acknowledged, the City and Developer hereby agree as
follows:
1. The following term set forth in Section 2 of the Agreement(Definitions) is hereby
amended as follows:
Completion Deadline means August 31, 2011.

3. All terms in this Amendment that are capitalized but not defined shall have the
meanings assigned to them in the Agreement.
4. All terms and conditions of the Agreement that are not expressly amended
pursuant to this Amendment shall remain in full force and effect.

HEARING:
SUBJECT: Authorize Amendment No. 1 to City Secretary Contract No. 41182, an Economic
Development Program Agreement with Robert G. Muckleroy, for Extension of the Project
Deadline to August 31, 2011 (COUNCIL DISTRICT 5)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to
City Secretary Contract No. 41182, an Economic Development Program Agreement with Robert G.
Muckleroy, for extension of the project deadline to August 31, 2011.
DISCUSSION:
On July 27, 2010, the City Council authorized the execution of an Economic Development Program
Agreement (EDPA)with Robert G. Muckleroy, pursuant to which Mr. Muckleroy (Developer) was to
complete the development of an office facility for the Texas Department of Criminal Justice on Carey
Street in Fort Worth (M&C C-24368). Under the EDPA, the Developer would be given a series of up
to 10 grants equivalent to the amount of incremental real property taxes paid to the City up to a
maximum cumulative grant of$91,374.00. The EDPA required the facility to be completed by May 1,
2011.
Due to unforeseen delays in acquiring the property and obtaining a building permit, the Developer is
requesting an extension of the completion deadline to August 31, 2011. Staff agrees that these
factors were outside the control of the developer, that this request is reasonable and should be
granted.
This project is located in COUNCIL DISTRICT 5.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that this action will have no material effect on
City funds.
