WHEREAS, the City of Fort Worth (City� and Carter & Burgess,
Inc., (Engineer) made and entered into City Secretary Contract No.
20821, (the Contract) which was authorized by the City Council by
M&C C-14608 on the 13th day of December 1994; and subsequently
revised by four previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Sanitary Sewer Main 42
and 54 Drainage Psea I/I Evaluation Study and Sewer System
Improvements (Group 4, Contract 1).

NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated March 24, 1999, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional services
to be performed by Engineer total $3,510.00.
2.
Article III, Section D of the Contract is amended to provide
for an increase in the maximum fee to be paid to Engineer for all
work and services performed under the Contract, as amended, so
that the total fee paid by the City for all work and services
shall not exceed the svm of $442,030.75.

3.
All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Tony:
We are providing this letter as our request for additional compensation to address design
modifications requested by the City during the most recent review of the final plans. The
requested modifications primarily reflect recent revisions to Water Department and
Department of Engineering standards. As you know, this design was completed under the
Part 3 designation and being constructed, but was discontinued because of the delay
associated with the Railroad utility crossing permit.
The comments made during the last review of the plans have been summarized in the
attached table along with our response. We propose to complete this work in accordance
with the attached response table and listing of hours for a lump sum amount of $3,510.
Please see the Contract Fee Summary below.

SYSTEM IMPROVEMENTS (GROUP 4, CONTRACT 1), SEWER PROJ-
ECT NO. PS46-070460410180
The proposed amendment will reimburse Carter & Burgess, Inc., for the additional design serv-
ices that were provided on the project as requested by City.
During construction of Part 3 of this project in 1997, it was determined that a railroad permit was
needed on Fort Worth and Western Railroad in order to construct a project sewer line. Due to the
very long delay in obtaining this permit, the construction contract was terminated and the project
was placed on hold until the permit was obtained.
The railroad permit was finally obtained in February 1999. However, before the remainder of the
project can be re-advertised for bids, it is necessary to revise the previously approved plans and
specifications so that they conform with current City standards.
Carter & Burgess, Inc., has requested a fee of $3,510.00 for the additional services to be pro-
vided thereby increasing the contract fee from $438,520.75 to $442,030.75. I believe this fee is
fair and reasonable for the additional services.
Please authorize the additional design fee by your signatures on the attached contract amendment
form.
