C 02 WHEREAS, the City of Fort Worth (City) and Matyastik & Phillips Investments LLC (Developer) entered into a Community Facilities Agreement, City Secretary Contract No. 41-�ZLI ("CFA"); and WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to add City participation in an amount not to exceed $18,742.11 for the City's portion of costs associated with the 8-inch water main construction contemplated by the CFA; and WHEREAS, the City Council authorized execution of Amendment No. 1 to the CFA on the day of pm�, , 2011 via M&C C,-,q L}$a7 . NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CFA: 1. The City's portion of inspection and material testing fees are directly allocated to the City's accounts for charges and does not reimburse the Water Inspection and Material Testing Fes to the developer. DISCUSSION: Matyastik & Phillips Investments LLC, the developer of Matyastik Addition No. 2 has executed a proposed contract for community facilities to serve a development located in Fort Worth Extraterritorial Jurisdiction (ETJ) (see attached map). The application for outside city water and sewer services was approved on November 9, 2010 as M&C C-24568. Total construction cost for water and sewer improvements for this development is $44,341.71. There will be City participation for the construction of eight-inch water main that will improve the service to the Matyastik Addition No. 2 and surrounding area.
