AN ORDINANCE ORDERING A SPECIAL ELECTION BY THE
QUALIFIED VOTERS OF THE CITY OF FORT WORTH, TEXAS,
ON MAY 10, 2014, FOR THE PURPOSE OF ELECTING A CITY
COUNCIL MEMBER FOR CITY COUNCIL DISTRICT 9 TO
SERVE THE REMAINDER OF AN UNEXPIRED TERM
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
'TEXAS:
SECTION 1.
ELECTION ORDERED
In compliance with the Charter of the City of Fort Worth and in accordance with the
Constitution and laws of the State of Texas, the City Council hereby orders that a special election
be held on Saturday, May 10, 2014, as authorized by section 41.001 of the Texas Election Code,
at which all qualified voters of City Council District 9 may vote for the purpose of electing a
council member from District 9 to serve the remainder of an unexpired term until the regular
City Council election in May 2015. The City Council hereby finds that the date at which said
election shall be held is not less than seventy-one (71) days frorn the date this Ordinance is
adopted.
SECTION 2.
CANDIDATES
Candidates may file an application for a place on the special election ballot commencing
once this Ordinance is adopted, in the City Secretary's Office, located in the Municipal Building,
1000 TI-trockmorton, Fort Worth, Texas. The filing deadline is 5 p.m. on March 10, 2014.
SECTION 3.
BALLOT
The City Secretary of said City shall ensure that ballots are prepared to be used in said
special election, on which ballots shall be printed the names of the candidates for the position of

City Council Member, District 9. The ballots shall be printed in English and in Spanish for use
in said special election.
SECTION 4.
DRAWING FOR PLACES ON THE BALLOT
In the event there are two or more candidates for the unexpired term of Council Member,
Place 9, the order in which the names of such candidates are to be printed on the ballot shall be
determined by a drawing to be conducted by the City Secretary; that three (3) clays prior to the
date on which the drawing is to be held, the City Secretary shall post a notice in the City Hall of
the time and place of the drawing and shall also give personal notice to any candidate who makes
written request therefor and furnishes to the City Secretary a self-addressed stamped envelope;
and that each candidate involved in the drawing or a representative designated by him or her
shall have a right to be present and observe the drawing.
SECTION 5.
EARLY VOTING CLERKS
(a) Steve Raborn, Tarrant County Elections Administrator, or his successor, shall serve as
the early voting clerk for the Tarrant County portion of the election.

SECTION 6.
EARLY VOTING
(a) Early Voting by personal appearance of Fort Worth residents shall be conducted
beginning April 28, 2014, and continue through May 6, 2014.
(b) The main Early Voting locations and times for Fort Worth residents are:

(c) The locations and times at which early voting shall be conducted at branch early voting
polling locations are contained in Exhibit A, attached hereto. The City Secretary may
change the places and/or times contained in Exhibit A without further City Council action
or approval after consulting with the Tarrant County Elections Administrator and
determining that a change in place and/or time is necessary.
SECTION 7.
VOTING SYSTEM
(a) An electronic voting system, as defined in Chapter 121 of the Texas Election Code, shall
be used for voting at the regular polling places for said election and for counting the
ballots and for tabulating the results. The conduct of the election and the use of the
electronic voting system shall be in accordance with the Texas Election Code.
(b) 'The Office of the Tarrant County Elections Administrator, 2700 Premier Street, Fort
Worth, Texas, is established as the Central Counting Station for the ballots cast in TalTant
County in said election.

(c) Tarrant County shall appoint an individual, having knowledge and experience in the
conduct of elections with the electronic voting system for which the Central Counting
Station is established, as Manager ofthe Central Counting Station. The Manager shall be
in charge of overall administration of the County's Central Counting Station and the
general Supervision of the personnel working at the Station.
(d) Tarrant County shall appoint an individual trained in the operation of the automatic
tabulating equipment as Tabulation Supervisor. The Tabulation Supervisor shall be in
charge of the operation of the automatic tabulating equipment.
(e) 'Tarrant County shall appoint an individual as Assistant to the Tabulation Supervisor.
Such Assistant shall assist the 'Tabulation Supervisor in the operation of the automatic
tabulating equipment as directed by the Tabulation Supervisor.
(f) Tarrant County shall appoint art individual as Presiding Judge of the Central Counting
Station. The Presiding Judge shall maintain order at the Central Counting Station and
shall have such authority as may be prescribed by the Texas Election Code.
(g) The polling places shall be kept open on May 10, 2014, from 7:00 a.m. to 7:00 p.m., and
that due return shall be made to the City Council showing the number of' votes cast for
the office of Fort Worth City Council, Place 9.
(h) 'The locations of the election day polling places for the election are contained in
Exhibit B, Election Day Polling Sites, attached hereto. The City Secretary may change
the places arid/or times contained in Exhibit B without further City Council action or
approval after consulting with the Tarrant County Elections Administrator and
determining that a change in place and/or time is necessary.
SECTION 8.
RUNOFF
Any candidate receiving a majority of all the votes cast for the office for which he or she
is a candidate shall be elected to such office. In the event of a tie or in the event that no
candidate receives a majority of all votes cast for the office sought, the Mayor, on the first day
after the completion of the official tabulation and canvass of the returns, shall issue a call,
proclamation and notice for a second election, as required by law, to be held on June 21, 2014, to

fill that place. At such second election, the names of the two candidates receiving the highest
number of votes for such office in the first election shall be printed on the ballot.
SECTION 9.
PROCLAMATION
This ordinance shall constitute the proclamation, call, notice and ordinance calling and
ordering said election.
SECTION 10.
PUBLICATION
Notice of said election shall be given by publishing a Notice of Election, in English and
in Spanish, at least once, not earlier than the 30"' day or later than the 10`h day before election
day in a newspaper published in said City. A copy of this ordinance, in English and in Spanish,
shall be posted on the City's board used for posting notices of the meeting of the Fort Worth City
Council not later than the 21" day before election day.
SECTION 11.
NOTICE
That the way and manner of holding said election, the notice to be given therefor, the
polling places, the personnel and the officers who are to hold same, and all details connected
with the holding of the election shall be provided for and arranged by the City Secretary; that the
proper notice and publication of this notice, proclamation, call and ordinance shall be only
cumulative of and in addition to the statutory notice of said election as herein provided; and that
any omission or irregularity in this notice or in the publication or posting of this notice,
proclamation, call and ordinance, or in the signing of same, shall not in any way affect or
invalidate such election.

SECTION 12.
CONTROLLING LAW
That in all respects, said election shall be conducted in accordance with the Texas
Election Code and the Charter of the City of Fort Worth, Texas.
SECTION 1.3.
OPEN MEETING COMPLIANCE
That it is hereby officially found and determined that the meeting at which this Ordinance
was adopted and said election was called was open to the public and public notice of the time,
place and purpose of said meeting was given, all as required by Chapter 551 of the Texas
Government Code.
