ASSIGNMENT OF ENCROACHMENT AGREEMENT
[City Secretary Contract No. 41834]
WHEREAS, on the 16`h day of May, 2011, the City of Fort Worth, acting by and through
its duly authorized Planning and Development Department Director, herein after referred to as
the "City," entered into an Encroachment Agreement (recorded in the Official Records of Tarrant
County, Texas as Instrument # D211137578) with U Development Partners, LLC, a Texas
limited liability company, acting by and through its duly authorized manager, hereinafter referred
to as "Grantee," owner of the property located at 3201 S. University Drive, Fort Worth, Texas
("Property"), and being more particularly described on Exhibit A attached hereto and made a
part hereof:
WHEREAS, the current Grantee under the Agreement, U Development Pariners, LLC
"Assignor," desires to assign the Agreement to University Drive Apartments, LP, a Texas limited
partnership, "Assignee":
NOW THEREFORE, the City of Fort Worth does hereby consent to the assignment of
the Agreement from Assignor to Assignee.
As consideration for the Assignment of the Agreement, Assignor assigns and Assignee
hereby expressly accepts and assumes all obligations and liabilities of Assignor under the terms
of the Agreement and agrees to be bound by all the terms, provisions and covenants therein.
