t CITY SECRETARY CONTRACT N0. 14 a D i I - A 1 A1T NO.1 TO CITY SECRETARY CONTRACT AREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 42011, (the CONTRACT) which was authorized by M&C on the twentieth day of July, 2011 in the amount of $ 398,735; and WEMUCAS, the CONTRACT involves engineering services for the following study: Tributary SC-7 and Edgecliff Branch Open Channel Study (SWS-036) ; and AREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW TIMMEFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated February 22, 2012, a copy of which is attached hereto and incorporated herein. The cost to City for the additional study services to be performed by Engineer totals $84,553 .00. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $483, 288 . 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Preparation of an open channel study report for the upper end of Edgecliff Branch and French Lake Creek, 7. Redelineation of the floodplains for the upper end of Edgecliff Branch and French Lake Creek; and 8. Preparation of a Letter of Map Revision (LOMR) for the upper end of Edgecliff Branch and French Lake Creek for submission to FEMA, if necessary. Attached Figure 1 shows the proposed additional study area to be analyzed. The total for the proposed services is $84,533 including additional engineering services, field survey and administration fees. This brings the total contract amount to $483,288. SWS-036 AMENDMENTS TO THE STANDARD SCOPE OF SERVICES, ATTACHMENT "A" Project Summary a. Purpose of Study Freese and Nichols (ENGINEER) is pleased to submit this proposal for additional flood study per City of Fort Worth (CITY) request for Edgecliff Branch and its tributary French Lake Creek (See Figure 1). The additional study was requested for the Tributary SC-7 and Edgecliff Branch Open Channel Study (Study No. SWS-036) currently in progress. Additional tasks include stream condition assessment, field survey, hydraulic study, watershed flood hazard assessment, proposed flood mitigation alternatives analysis, report preparation and Letter of Map Revision preparation and submittal assistance for approximately 1.3 stream miles of Edgecliff Branch and approximately 1.2 stream miles of French Lake Creek. b. Pertinent Data The additional reach of Edgecliff Branch to be studied for this Open Channel Study is from the Woodway Drive crossing (downstream) to South Hulen Street (upstream). The study will also include the French Lake Creek tributary to Edgecliff Branch between Willow Way Road (downstream) to Trail Lake Drive (upstream). See Figure 1 — Additional Edgecliff Branch and French Lake Creek Study Areas Map for study stream limits. Task 2: Data Search, Collection, Field Reconnaissance, Stream Condition Assessment, and Surveys c. Stream Condition Assessment ENGINEER will perform a stream geomorphology evaluation for Edgecliff Branch and its tributary French Lake Creek (approximately 2.5 miles) to identify existing and potential erosion areas and to propose channel stabilization alternatives. Task 1 — Site Visit A stream assessment will be conducted to evaluate the current condition of the creek. This will be achieved by conducting a geomorphic assessment of the channel at 200 foot intervals. During the stream assessment the sediment source and discharge areas will be located as well as all hard points within the creek. The field survey will include a visual summary of channel conditions by river reach (photographs of the left and right bed and bank and upstream and downstream). The bed and bank material will be EXHIBIT"A-3" Page 1 of 3 sampled for sieve analysis. The geology of the reach will be noted considering the rock type, degree of weathering, and thickness of the alluvial soils. Bank stability and degree of erosion will be noted, as well as the distance to and type of structure that may be impacted. Channel dimensions will be measured with a survey rod and laser to determine bank geometry. All locations will be marked with GPS receiver employing sub-meter accuracy. Preparation for the field is also included in this task. Task 2 — Preliminary Evaluation Preparation for the channel stability assessment report will include desk top analysis of the soils, landuse, channel and landscape, and geology. A field assessment overview will include the bed and bank material evaluation and calculation, equilibrium slope calculation, reach survey channel geometry calculations and reach structure and distance from channel. For stream assessment calculations, the design or dominant flows from the models will be obtained from the modeling component of this project. Evaluation will include a summary of the study area, channel stability assessment methodology, and field assessment methodology. There will be a field assessment overview describing the geology and soils, bed material evaluation, equilibrium slope, and meander migration potential. The field survey results will include the reach survey data, the reach survey channel erosion, the reach survey channel geometry, and possible reach survey structure and distance from channel. Deliverables will also include labeled digital photos and locations of special physical characteristics that may be relevant to modeling and locations of observed areas of concern in addition to comments on the present conditions. d. Field Surveys For the additional Edgecliff Branch and French Lake Creek Open Channel study there are approximately five (5) open channel cross-sections, approximately six (6) hydraulic structures, and approximately five (5) residential or commercial structures finished floor elevations to be surveyed. The anticipated field survey locations are shown on Figure 1 — Additional Edgecliff Branch and French Lake Creek Study Areas Map. The anticipated hydraulic structures to be surveyed are listed below. Model Development Hydraulics The 2009 TNRIS LiDAR shall be used for hydraulic model development. EXHIBIT"A-3" Page 2 of 3 1. Hydraulic models will be developed for Edgecliff Branch (1.2 mi) and French Lake Creek (1.3 mi). a. Hydraulic models will be based on surveyed cross sections and the 2009 TNRIS LiDAR. Hydraulic models will also attempt to utilize existing recent LOMR model/flood study information where possible. Existing LOMRs/flood studies include: i. French Lake b. There are approximately three (3) bridge/culvert crossings of Edgecliff Branch and three (3) bridge/culvert crossings of French Lake Creek that are proposed to be field surveyed. See Figure 1 —Additional Edgecliff Branch and French Lake Creek Study Areas Map. c. Floodplain redelineation will tie-in to the downstream reach of Edgecliff Branch currently being studied at Woodway Drive. Task 6: Proposed Flood Mitigation Alternative Analysis The ENGINEER will develop proposed improvement alternatives and corresponding conceptual cost opinions to reduce flooding impacts for the following: 1. Edgecliff Branch a. Develop up to a total of three (3) potential regional detention, buy-out and/or channel improvement alternatives. b. Develop proposed sizes for roadway crossings to provide 100-year capacity for fully developed watershed conditions. 2. French Lake Creek a. Develop up to a total of two (2) potential regional detention, buy-out and/or channel improvement alternatives. Develop proposed sizes for roadway crossings to provide 100-year capacity for fully developed watershed conditions. 3. Local Improvement Recommendations a. Development of minor local improvement recommendations that are identified during the study such as localized erosion repair along the creek. Local improvement recommendations will be made Edgecliff Branch and French Lake Creek. Consideration will be given to geomorphologic channel condition assessment when suggesting localized improvements. Task 8: Letter of Map Revision Application and Support (if required) The ENGINEER shall prepare a LOMR request for Edgecliff Branch upstream of Woodway Drive and for French Lake Creek. SWS-036 COMPENSATION AND PAYMENT SCHEDULE A. The Engineer shall be compensated a total lump sum project fee of $84,553. Payment of the total lump sum fee shall be considered full compensation for the services described in Attachment "A" and Exhibit "A-3" for all labor materials, supplies and equipment necessary to complete the project. B. The Engineer shall be paid in accordance with Exhibit "13-1", Supplement to Attachment B. Each invoice from the Engineer shall be verified as to its accuracy and compliance with the terms of this contract by an officer of the Engineer. C. Additional tasks assigned by the CITY not included in Attachment "A" or Attachment "A-3" Scope of Services will be billed on an hourly basis. These tasks will not be performed without written authorization from the CITY. A summary of current hourly billing rates is provided in Exhibit "13-2". D. Professional Services Fee summary is provided in Exhibit "13-3". E. A Summary of Total Project Fees including MWBE participation percentages is provided in Exhibit "B-3A". F. SWS-036 METHOD OF PAYMENT 8 PROGRESS REPORT REQUIREMENTS I. Method of Payment Partial payment shall be made to the Engineer monthly based on a percentage of work performed upon City's approval of an invoice from the Engineer outlining the current labor and expenses of the total project. The aggregate of such monthly partial fee payments shall not exceed the following: Project Phase Estimated Project Percent Complete Hydraulic Study Phase 75% Preliminary Report 90% Final Report 100% The balance of fees, less previous payments, shall be payable after delivery of the FINAL report and electronic files. II. Progress Reports A. The Engineer shall submit to the designated representative of the Director of the Department of Transportation/Public Works monthly progress reports covering all phases of the analysis in the format required by the City. (G&AI) is pleased to submit this proposal for professional land surveying services for the above referenced projects. Work will be performed in conformance with the scope and schedule found in Exhibit D — Prime Agreement included as part of this Sub-consultant Agreement and the details in Attachment Al and the requirements of Appendix M of FEMA Data Capture Standards. The following itemized surveying tasks are required for the project: Professional Services relative to this agreement include support on services relative to: ATTACHMENT A Task 2: Data Search, Collection, Field Reconnaissance, Stream Condition Assessment, and Surveys d. Field Surveys e. Finished Floor Elevations EDGECLIFF BRANCH Item 1 - Field survey to obtain cross sections in open channel segments and information on existing stream crossing structures (bridges and culverts) along Edgecliff Branch in the City of Forth Worth, Texas. Survey and submittal of field notes, drawings, etc. shall be completed within four to six weeks of a notice to proceed. Survey consists of: 5 cross sections $ 3.625.00 total cost (limits being shown in an exhibit dated 11/14/2011 as provided by Engineer). Item 2 — Field survey to obtain finished floor elevations at selected locations as specified by engineer. Survey and submittal of field notes, drawings, etc. shall be completed within six to eight weeks of a notice to proceed. Survey consists of: 5 structures @ $ 90.00 per structure (for a total of$ 450.00). Item 3 — Obtain the necessary Right-Of-Entry before entering upon private property. Right-Of-Entry letters will be prepared to City of Fort Worth Standards. 5 ROE @ $ 125.00 per document (for a total of$ 625.00). The horizontal control shall be established the Texas State Plane Coordinate System, North Central Zone, NAD83 and the vertical control shall be set from NAVD 88 datum and tied to the City of Fort Worth Datum by utilizing GPS/RTK- VRS methodology. DISCUSSION: A flood study of the SC-7 and Edgecliff Branch tributaries of Sycamore Creek is currently contracted with Freese and Nichols, Inc. In the course of the study, it was determined that the study area needs to be extended to include French Lake and the tributaries between Woodway Drive and Trail Lake Drive. This on-going study will develop mitigation alternatives to protect homes from flooding, evaluate the engineered channel from Trail Lake Drive to South Hulen Street, and revise mapped floodplain as needed. The SC-7 and Edgecliff Branch tributary open channel study was approved by the City Council on July 12, 2011(M&C C-24995). Freese and Nichols, Inc., proposes to perform this amendment to the study for a lump-sum fee in the amount of$84,553.00. City Staff considers this fee to be fair and reasonable for the scope of services proposed, based on the size of the watershed and the length of the stream. The original study and current amendment will be funded through the Stormwater Utility Fund. Freese and Nichols, Inc., is in compliance with the City's M/WBE Ordinance by committing to 18 percent M/WBE participation. The City's goal for this project is 18 percent. This project is located in COUNCIL DISTRICT 6.
