AN ORDINANCE ESTABLISHING PLACES FOR EACH FULL TIME
JUDGE POSITION APPROVED BY CITY COUNCIL: APPOINTING
CHARLES T. ATKINSON, ANDREW T. BRADSHAW, RAQUEL D.
BROWN, ANN Y. COLLINS, SIMON C. GONZALEZ, BENITA FALLS
HARPER, NINFA L. MARES, CLAUDIA A. MARTINEZ, R. NEEL
MCDONALD, SHARON NEWMAN-STAN FIELD, JO ANN REYES,
JAMES D. RODGERS, AND PATRICIA L. SUMMERS AS MUNICIPAL
JUDGES FOR A TWO-YEAR TERM COMMENCING APRIL 1, 2014
AND ENDING MARCH 31, 2016 OR UNTIL A SUCCESSOR IS
QUALIFIED AND APPOINTED IN ACCORDANCE WITH STATE
LAW; PROVIDING THAT ALL PERSONS PRESENTLY HOLDING AN
APPOINTED POSITION AS JUDGE BUT WHO ARE NOT LISTED IN
THE ORDINANCE ARE NOT REAPPOINTED; APPOINTMENT OF
CHIEF JUDGE AND DEPUTY CHIEF JUDGE; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF .rHE CITY OF FORT WORTH,
TEXAS:
SECTION 4.
The Judge position currently held by the Chief Judge 'Ninfa L. Mares will now be
designated as Municipal Court Judge Place 1 . The Judge position currently held by the Deputy
Chief Judge James D. Rodgers will now be designated as Municipal Court Judge Place 2. The
Judge position currently held by Stephanie J. Bearner is now designated as Municipal Court
Judge Place 3. The Judge position currently field by Andrew T. Bradshaw is now designated as
Municipal Court Place 4. The Judge position currently held by Raquel D. Brown is now
designated Municipal Court Judge Place 5. The Judge position currently held by Simon C.
(3onzalez is now designated as Municipal Court Judge Place 6. The Judge position cuiTently
held by Benita Falls Harper is now designated as Municipal Court Judge Place 7. The Judge
position currently held by R. Neel McDonald is now designated as Municipal Court Judge Place

8. The Judge position currently held by Sharon Newman-Stanfield is now designated as
Municipal Court Judge Place 9. The Judge position currently held by Jo Ann Reyes is now
designated as Municipal Court Judge Place 10. A currently vacant judge position is now
designated as Municipal Court Judge Place 11 . The Judge position currently held by Claudia A.
Martinez is now designated as Municipal Court Judge Place 12. A currently vacant judge
position is now designated as Municipal Court Judge Place 13.
SECTION 2.
That, the following individuals are now appointed as Municipal Judges for a two-year
term commencing April 1, 2014 and ending March 31, 2016, or until a successor is qualified and
appointed in accordance with state law:
Municipal Court Judge Place 1: Ninfa L. Mares;
Municipal Court Judge Place 2: James D. Rodgers;
Municipal Court Judge Place 3: Patricia L. Summers;
Municipal Court Judge Place 4: Andrew T. Bradshaw;
Municipal Court Judge Place 5: Raquel D. Brown;
Municipal Court Judge Place 6: Simon C. Gonzalez;
Municipal COUrt Judge Place 7: Benita Falls Harper;
Municipal Court Judge Place 8: R. Neel McDonald;
Municipal Court Judge Place 9: Sharon Newt-nan-Stanfield;
Municipal Court Judge Place 10: Jo Ann Reyes;
Municipal Court Ridge Place 11: Am Y. Cotlins;
Municipal Court Judge Place 12: Claudia A. Martinez; and
Municipal Court Judge Place 13: Charles T. Atkinson.
Any individual presently holding an appointed position as a judge, but who is not listed in
this ordinance as being appointed to a place, is not reappointed to their office. Appointment to a
place does not mean appointment to a specific court or division. Assignment to a court remains

within the authority of the Chief Judge as authorized by Section 10-3 of Chapter 10, Courts of
the Fort Worth City Code.
SECTION 3.
That Ninfa L. Mares be appointed as Chief Judge and that James D. Rodgers be
appointed as Deputy Chief Judge.
SECTION 4.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where provisions of this ordinance are in
direct conflict with the provisions of such ordinances an(l Code, in which event such conflicting
provisions Of Such ordinances and Code are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared void, ineffective or
unconstitutional by the valid judgment or final decree of a Court of competent jurisdiction, such
ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same would have been enacted by
the City Council, without the incorporation herein of any such void, ineffective or
unconstitutional phrase, clause, sentence, paragraph or section.

SECTION 6.
This ordinance shall take effect upon adoption.

Adopt Ordinance Establishing Places for Each Full-Time Judge Position and Appointing the Municipal
Judges, Chief Judge, and Deputy Chief Judge for a Two-Year Term Commencing April 1, 2014 and Ending
March 31, 2016 (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance establishing places for each full-time judge position and designating a
place for each individual named in the ordinance recommended for appointment as a Municipal Court
Judge;
2. Appoint Andrew T. Bradshaw, Raquel D. Brown, Simon C. Gonzalez, Benita Falls Harper, Ninfa L.
Mares, Claudia A. Martinez, R. Neel McDonald, Sharon Newman-Stanfield, Jo Ann Reyes, James D.
Rodgers, Charles T. Atkinson, Ann Y. Collins and Patricia L. Summers, as Municipal Judges for a two-
year term commencing April 1, 2014 and ending March 31, 2016, or until a successor is qualified and
appointed, in accordance with state law; and
3. Designate Ninfa L. Mares as Chief Judge and James D. Rodgers as Deputy Chief Judge.
DISCUSSION:
On February 17, 2014, the Ad Hoc Municipal Court Advisory Committee voted to reappoint Ninfa L. Mares
as Chief Judge and reappoint James D. Rodgers as Deputy Chief Judge for a two-year term commencing
April 1, 2014 and ending March 31, 2016.
On the same date, the Ad Hoc Municipal Court Advisory Committee voted to recommend to the City
Council that Andrew T. Bradshaw, Raquel D. Brown, Simon C. Gonzalez, Benita Falls Harper, Ninfa L.
Mares, Claudia A. Martinez, R. Neel McDonald, Sharon Newman-Stanfield, Jo Ann Reyes and James D.
Rodgers be reappointed as Municipal Judges for a two-year term commencing April 1, 2014 and ending
March 31, 2016. Any sitting judge not named is not recommended for reappointment.
Thereafter, on February 24, 2014, the Ad Hoc Municipal Court Advisory Committee voted to recommend
to the City Council the appointment of Charles T. Atkinson, Ann Y. Collins and Patricia L. Summers as
Municipal Court Judges for a two-year term commencing April 1, 2014 and ending March 31, 2016.
Chapter 30, Section 30.00006 (b) of the Texas Government Code under the Uniform Municipal Court Act
requires the governing body of a municipality to appoint its Municipal Judges by ordinance and designate
a Deputy Chief Judge and a Chief Judge, pursuant to Section 30.00007.

place does not mean appointment to a specific court or division, Assignment to a court remains within the
authority of the Chief Judge, as authorized by Section 10-3 of Chapter 10. Courts of the Fort Worth City
Code.

$43.03 per hour for a six month periOd, then increased to $45.29 per hour for the remainder Cf the judges'
term Total estimate for each position for the remainder of the Fiscal Year 2014 is $44.751.20. for a total
estimated amount of $134,253.60.
