HomeMy WebLinkAboutResolution 4311-04-2014 A Resolution NO. 4311-04-2014 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, PROVIDING AN EXEMPTION FROM THE INSCRIPTION REQUIREMENT FOR CERTAIN MUNICIPAL VEHICLES OPERATED BY THE FIRE, CODE COMPLIANCE AND AVIATION DEPARTMENTS. WHEREAS, Section 721 .004 of the Texas Transportation Code requires that motor vehicles owned by a municipality must be inscribed with the name of the municipality, along with the department or office having custody of the vehicle; and WHEREAS, Section 72 1 .005 of the Texas Transportation Code provides that the governing body of a municipality may exempt certain vehicles owned by th.e Municipality from the inscription requirement of Section 721 .004 if those vehicles are used by a municipal fire marshal, arson investigator, code enforcement officer designated to enforce environmental criminal laws, or a municipal employee conducting an investigation involving fraud or other mismanagement within the municipality; and WHEREAS, the Fire, Code Compliance and Aviation Departments are at times required to conduct investigations involving possible criminal or fraudulent activities; and WHEREAS, the City Council of the City of Fort Worth desires to exempt certain vehicles operated by the Fire, Code Compliance and Aviation Departments from the inscription requirement in order to facilitate undercover work and other legitimate investigative functions; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: 1 . Pursuant to Section 721 .005 of the Texas Transportation Code, certain vehicles used by the Fire, Code Compliance and Aviation Departments in the conduct of criminal or fraud Investigations are hereby exempted from the inscription requirement of Section 721 .004 of the Texas Transportation Code, 2. No. 4311-04-2014 DATE: Tuesday, April 15, 2014 REFERENCE NO.: **G-18178 LOG NAME: 21 REGULAR EXEMPT PLATES SUBJECT: Adopt Resolution Exempting Certain Vehicles Operated by the Fire, Code Compliance and Aviation Departments from the Inscription Requirements and Authorizing Use of Regular License Plates (ALL COUNCIL DISTRICTS) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached resolution exempting certain vehicles operated by the Fire, Code Compliance and Aviation Departments from the inscription requirements of Section 721.004 of the Texas Transportation Code; and 2. Authorize the City Manager to execute all documents pertaining to the application for regular license plates for certain vehicles for the Fire, Code Compliance and Aviation Departments. DISCUSSION: In December 1987, (M&C G-7385) the Police Department was granted permission to use regular exempt license plates on vehicles used for undercover work. Until mid-February 2014, regular plates were allowed for other departments. The Fire, Code Compliance, and Aviation Departments are requesting permission to obtain regular license plates for certain unmarked vehicles to be used in criminal and fraud investigations. The Tarrant County Tax Assessor-Collector's Office requires a resolution adopted by the City Council, pursuant to the Transportation Code, Section 721.005, designating exemption from inscription requirements for certain unmarked vehicles prior to issuance of regular plates.
