HomeMy WebLinkAboutResolution 4317-04-2014 A Resolution NO. 4317-04-2014 RENEWAL OF THE OAKLAND CORNERS NEIGHBORHOOD EIVIPOWERMENT ZONE WHEREAS, on April 25, 2000 the City of Fort Worth City Council ("Council") approved a Policy Statement on the Creation of Local Neighborhood Empowerment Zones; and WHEREAS, on October 3, 2000 the Council approved the criteria to determine whether an area would be eligible to be designated as a Neighborhood Empowerment Zone (NEZ); and WHEREAS, on January 6, 2009, the Council approved the creation of the Oakland Corners NEZ and Fort Worth Neighborhood Empowerment Reinvestment Zone (FWNERZ) No. 36; and WHEREAS, it is being proposed that the Oakland Corners NEZ be renewed as shown on Exhibit A; and WHEREAS, the Council finds that the renewal of the Oakland Corners NEZ: (1) would promote the creation or rehabilitation of affordable housing in the zone and an increase in economic development in the zone, and (2) is 100% within the Central City and 86% within the Community Development Block Grant eligible area; and WHEREAS, the Council finds that the creation of the Oakland Corners NEZ benefits and is for the public purpose of increasing public health, safety and welfare; and WHEREAS, the council finds that the Oakland Corners NEZ satisfies the requirements of Section 312.02 of the Tax Code; and WHEREAS, the Council finds that the proposed renewal of the Oakland Corners NEZ meets the criteria for NEZ designation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: Section 1. The facts and recitations contained in the preamble of this Resolution are hereby found and declared to be true and correct. Section 2. The Oakland Corners NEZ is hereby renewed as set forth in Exhibit A, F WORT .g� &]�Pg Resolution No. 4317-04-2014 Oakland Corners Neighborhood Empowerment Zone & Oakland Corners Neighborhood Empowerment Reinvestment Zone No. 36. Section 3. The Council adopts all basic incentives as described in the Neighborhood Empowerment Zone Basic Incentives (M&C G-17901) and as amended for the Oakland Corners NEZ area renewal. Section 4. J'he designation shall expire on April 21, 2024. Daggett Survey, Abstract Number 431, the William Mann, Abstract Number 996, the William R. McFaddin Survey, Abstract Number 1076, the J. L. Purvis Survey, Abstract Number 1228, the John Ringer Survey, Abstract Number 1287, the J. W. Adopt the attached resolution to re-designate the Oakland Corners area as a Neighborhood Empowerment Zone; and 3. Adopt the attached ordinance re-designating the Oakland Corners area as Fort Worth Neighborhood Empowerment Reinvestment Zone No 36, pursuant to the Texas Property Redevelopment and Tax Abatement Act, Tax Code, Chapter 312 DISCUSSION: On April 35. 2000. (K/I&C G-12897) the City Council approved the Policy Statement OD the creation of Local Neighborhood Empowerment Zone (NEZ) aDd amended it on December 7, 2010 /M&C G-17133\' in accordance with Chapter 378 of the Texas Lnoo| Government Code. The City Council also authorized the City Manager to identify neighborhood areas that may be eligible for NEZ designation and tDdevelop administrative procedures for the NEZProgram. The NEZAdminist[adVB Procedures were adopted by the City COUOCi| on October 3. 2000 (M&C G- 13030) and amended on May 15. 2007 and December 7. 2010 t0 initiate improved program requirements. The procedures included two methods by which a NEZ may be designated: 1. City Council designation; or 2. A neighborhood sponsor application process. On May 31. 3013' (Resolution No. 4209-U5-3013' M&CG-17BO1) the City Council elected tOb0 eligible 1O participate in tax abatements and has established guidelines and criteria governing Tax Abatement Agreements entered into by the Qty and various third parties, as authorized by and in accordance with Chapter 313of the Texas Tax Code. On January 6, 2009. (M&C (]-104D8) the City Council adopted Resolution No 3704to designate the Oakland Corners area as a Neighborhood Empowerment Zone (NEZ) and adopted Ordinance No. 18425 vVhiChdesigO@tedthe8naaaaFortVVorthNe|ghbOdhOOdEmpovvennentReinveatrneOtZoUe (FVVNERZ) N0. 36. The Oakland Corners NEZ will be re-clesignated NEZ by the City Council upon the adoption of the Resolution attached to this Mayor and Council Communication. The area within the Oakland Corners NEZ is also being re-clesignated as Fort Worth Neighborhood Empowerment Reinvestment Zone No. 36 (FWNERZ), pursuant to the Texas Property Redevelopment and Tax Abatement Act, Tax Code, Chapter 512so that tax abatements may be granted within the designated area. The main boundaries of the re-designated Oakland Corners NEZ and the FVVNEF|Z are: • View Street and K8e8dOvvbrOVkDrive on the north� • Beach Street on the vvest� • Union Pacific Railroad nnthe south; and • Edgmvvood Terrace onthe e8SL The re-designated Oakland Corners NEZ and the FVVNERZ have a population Vf0.494 persons, is135 miles in size and meets the following designation requirements under the City's NEZpolicy: • Promotes the creation 0f quality affordable housing in the zone; • Is 100 percent within the Central City and 86 percent of the proposed NEZ area is Community Development Block Grant (CL)BG) eligible; • Is considered distressed based on census data on population, socio-clemographics and other factors; • Meets the :ht8ha for Reinvestment Zone designation in that the area, is reasonably |ih8|y as a result of the designation to contribute 0J the retention or expansion of primary employment or to attract major inveEtrneMtiDtheZon9th8tvvOu|dbeabanefitt0the property, and that would contribute to the eCOOnmiC development of the City.
