HomeMy WebLinkAboutContract 38775-A6 my sECRETAW AMENDMENT No. 6 a� TO CITY SECRETARY CONTRACT No. WHEREAS, the City of Fort Worth (CITY) and Kennedy Consulting, Inc. , formerly known as Kennedy Consulting, Ltd. , (ENGINEER) made and entered into City Secretary Contract No. 38775, the CONTRACT) which was authorized by M&C C-23596 on the 16th day of June, 2009 in the amount of $ 1, 465, 379; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $ 21, 154 . 05 which was administratively authorized on the 29th day of November 2010, Amendment Number 2 in the amount of $121, 950 . 80 which was authorized by M&C # C-25348 on the 13th day of December 2011, Amendment Number 3 in the amount of $64, 400 . 00 which was authorized by M&C # C-25893 on the 2nd day of October 2012, Amendment Number 4 in the amount of $132, 200. 00 which was authorized by M&C # C- 26124 on the 5th day of March 2013; Amendment Number 5 in the amount of $63, 017 . 00 which was authorized by M&C # C-26418 on the 10th day of September 2013 and WHEREAS, the CONTRACT involves engineering services for the following project: Altamesa Boulevard Phase 2, formerly known as Dirks Road, from Chisholm Trail Parkway (SH 121) to Granbury Road; and WHEREAS, it has become necessary to execute Amendment No. 6 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated February 18, 2014, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $228, 625. 00 . (See Attached Funding Breakdown Sheet, Page -3-) 2 . DISCUSSION: This Agreement is for engineering services for the design of Altamesa Boulevard f/k/a Dirks Road as a six lane divided principal arterial from Chisholm Trail Parkway, SH 121 to Granbury Road City Project No. 00768. The project also includes a new railroad bridge structure, retaining wall, sidewalk, water main adjustments, traffic signal modifications and street lights. This contract amendment is for on—call construction phase engineering services that are required due to the complex nature of this multi—agency project.The construction phase services include quantity assessment, response to Request for Information (RFIs), review and assessment of change orders and related suggested alternatives,review and approval of shop drawings, site visits and planning meetings,final walk through and punch list and surveying services. City of Fort Worth Transportation and Public Works Department 1000 Throckmorton St. Fort Worth, TX 76102 Re: Dirks Road—Chisholm Trail Parkway (SH 121) to Granbury Road City Project No. 00768, City Secretary Contract No. 38775 Proposal to provide: 1) Construction Phase Services 2) Construction Surveying and Staking Dear Mr. Ingram: This letter is written in response to your request for Kennedy Consulting, Inc. to prepare a contract amendment for construction phase services related to the construction of Dirks Road. Kennedy Consulting, Inc. will complete the following additional scope: Additional Proiect Scope Task 1 — Construction Phase Services: The Engineer will provide on-call support services, at the City's request, during the construction of Dirks Road in Fort Worth, Texas. The support services for this authorization will include, but are not limited to: 1.1. Review of quantities from pay estimates. 1.2. Provide clarifications on construction plans, as needed, and respond to RFI's. 1.3. Review and provide feedback on change orders. This includes plan updates and development of alternate solutions that would best serve the City. 1.4. Review and approval of shop drawings. Such review, approvals or other action will not extend to means, methods, techniques, equipment choice and usage, sequences, schedules, or procedures of construction or to related safety precautions and programs and shall not relieve the Contractor from its responsibility for performance in accordance with the contract N= � Mr. Dennis Ingram,P.E.,February 18,2014 Page 2 of 4 KENNEDY CONSULTING for construction, nor is such review a guarantee that the work covered by the shop drawings, samples and submittals is free of errors, inconsistencies or omissions. 1.5. Periodic site visits and attend construction progress/planning meetings. Such visits and observations by the Engineer are not intended to be exhaustive or to extend to every aspect of Contractor's work in progress. Observations are to be limited to spot checking, selective measurement, and similar methods of general observation of the Work based on the Engineer's exercise of professional judgment. Based on information obtained during such visits and such observations, the Engineer will evaluate whether Contractor's work is generally proceeding in accordance with the Contract Documents, and the Engineer will keep the City informed of the general progress of the Work. The purpose of the Engineer's site visits will be to enable the Engineer to better carry out the duties and responsibilities specifically assigned in this Agreement to the Engineer, and to provide the City a greater degree of confidence that the completed Work will conform in general to the Contract Documents. The Engineer shall not, during such visits or as a result of such observations of Contractor's work in progress, supervise, direct, or have control over Contractor's work, nor shall the Engineer have authority over or responsibility for the means, methods, techniques, equipment choice and usage, sequences, schedules, or procedures of construction selected by Contractor, for safety precautions and programs incident to Contractor's work, nor for any failure of Contractor to comply with laws and regulations applicable to Contractor's furnishing and performing the Work. Accordingly, the Engineer neither guarantees the performance of any Contractor nor assumes responsibility for any Contractor's failure to furnish and perform its work in accordance with the Contract Documents. 1.6. Final walk through and punch list. The City will provide construction management services and inspection for the project. This scope of services shall not include construction phase services related to correcting errors or omissions in contract plans (which will be handled in accordance with the prime contract), material sampling/testing/reporting, field inspections (with the exception of Railroad Construction Inspection Services as provided by Amendment No. 2), disagreements between the City and the Contractor, or determination of substantial completion. These construction phase services shall be performed on-call, at the request of the City's project manager, on an hourly specified rate basis within the financial limits of this amendment. Task 2 — Construction Surveying and Staking: The Engineer will provide on-call surveying services, at the City's request, during the construction of Dirks Road in Fort Worth, Texas. These services shall include, but are not limited to: 2.1. Survey Control: Check, verify and densify existing survey control. Establish additional benchmarks on site. 2.2. Right of Way Staking: Stake permanent and temporary construction easements and right of way for clearing and grubbing. 2.3. Roadway Staking: Set convenient offsets on 50' stations and at all horizontal and vertical PC's, PT's and PI's for rough grade with elevations to subgrade. Set convenient offsets on 25' stations and at all horizontal and vertical PC's, PT's and PI's for final paving/curb with elevations to top of paving and or top of curb. 2.4. Storm Drain Staking: Set convenient offsets to the centerline of storm drain with flow line elevations. Set convenient offsets to all inlets,junction boxes, and etc. with flow line and or top of curb grades. 2.5. Waterline Staking: Set convenient offsets to the center of waterline with top of pipe elevations. 2.6. Retaining Wall Staking: Set convenient offsets to the face of wall with top of footer elevations. Set convenient offsets for all drill shafts with top of shaft elevations. Set/mark top of wall elevations for final wall construction. 2.7. Railroad Bridge Staking: Establish control at the centerline of the abutments and bents. Set convenient offsets to the centerline of drill shafts. Provide additional staking for caps and bearing seats. 2.8. Railroad Realignment Staking: Set convenient offsets on 100' stations and at all horizontal and vertical PC's, PT's and PI's for rough grade with elevations to subgrade. Set convenient offsets on 50' stations and at all horizontal and vertical PC's, PT's and PI's for final track layout. Check elevations of ballast, crossties and rail as needed. 2.9. Traffic Signal and Illumination Staking: Set convenient offsets for all traffic signals, light poles, conduit and structures associated with the signals and illumination. 2.10. Fort Worth& Western Railroad(FWWR) Requirements: a) Temporary Access Permit: Permit fees to access FWWR right of way. b) Safety Training: Employee training and badging fees for performing work on FWWR ROW. C) Flagging: Flagman fees during staking services. Task 2 and the associated fee are general in nature but are based on staking the items shown in the construction documents one time. Additional surveying services may be provided at the City's request within the financial limits of this amendment. The City will manage this portion of the contract.
