CONTRACT
MAINTENANCE COMMITMENT
THIS MAINTENANCE COMMITMENT (this "Commitment") is made
and given by HUNT INVESTMENT CORPORATION, a Delaware corpora-
tion qualified to do business in the State of Texas (herein-
after called "Hunt") , for the benefit of THE CITY OF FORT
WORTH, TEXAS, a Texas municipal corporation (hereinafter
called the "City") .
W I T N E S S E T H:
WHEREAS, Hunt is the current owner of certain land located
in Tarrant County, Texas traversed by or situated adjacent
to certain portions of the drainage channels of Big Fossil
Creek and Smithfield Creek, the current approximate center-
lines of such portions of such creeks being described on
Exhibit "A" attached hereto and made a part hereof for all
purposes (the "Creek Drainage Channels"); and
WHEREAS, Hunt intends to construct and install certain
dams and weirs, together with related improvements, along the
Creek Drainage Channels pursuant to Permit to Appropriate
State Water No. 4155, issued by the Texas Water Commission to
Hunt, recorded in Volume 8033, Page 1173 of the Deed Records
of Tarrant County, Texas and pursuant to Floodplain Development
Permit No. FP-64-012 (the "City Permit"), issued by the City
to Hunt (said dams and weirs and related improvements herein
collectively called the "Dams and Weirs"); and
WHEREAS, Hunt has agreed to provide this Commitment in
order to set forth the obligations, as between Hunt and the
City, with respect to the Dams and Weirs and with respect to
any floodway areas along the Creek Drainage Channels.
NOW, THEREFORE, in consideration of the premises and the
issuance of the City Permit by the City to Hunt, Hunt hereby
submits this Commitment, all upon the terms and conditions
set forth herein:
