To the Mayor and Members of the City Council
SUBJECT: STORMWATER FACILITY MAINTENANCE AGREEMENT
APPROVAL AUTHORITY
This Informal Report is provided to advise City Council of an upcoming staff recommendation that
administrative approval authority be granted for the execution of Stormwater Facility Maintenance
Agreements (SWFMA). On April 8, 2014 the City Council Infrastructure and Transportation
Committee was briefed about this planned recommendation. An M&C with this recommendation
will be on the June 03, 2014 City Council agenda.
An SWFMA is an agreement between the City and a private property owner obligating the
property owner to adequately maintain a stormwater control facility constructed as a part of a
private development project. Such facilities are often needed in order to ensure that the new
development does not create or aggravate drainage problems for adjacent properties or in the
public right-of-way. The City does not have the resources to take on maintenance responsibility
for these facilities.
Section 2.9 of the City Code requires City Council approval of most contracts, including
SWFMAs. An SWFMA does not directly obligate the City to expend any resources, though
maintenance responsibility could revert to the City in the event that the property owner reneges
on the agreement. Obtaining City Council approval of SWFMAs, however, requires significant
staff effort in preparation and processing of M&Cs and causes delays in private development
projects while awaiting City Council approval of the SWFMA. Staff's recommendation to grant
administrative approval authority for SWFMAs will reduce internal administrative costs and
expedite the approval of applicable new development projects.
