HomeMy WebLinkAboutResolution 4320-05-2014 A Resolution NO. 4320-05-2014 CANVASSING THE RETURNS AND DECLARING THE 'RESULTS OF THE SPECIAL ELECTION HELD ON MAY 10, 201.4, ON THE CONTINt'TATION OF THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT FOR FIVE (5) YEARS AND THE CONTINUATION OF THE DISTRICT'S ONE-HALF CENT SALES TAX FOR FIVE (5) YEARS WHEREAS, the Crime Control and Prevention District is governed by Chapter 363 of the Texas Local Government Code; and WHEREAS, on February 20, 2014, the Board of Directors of the Fort Worth Crime Control and Prevention District adopted a Resolution calling for an election to be field on May 10, 2014, on the continuation of the Fort Worth Crime Control and Prevention District (the "District") for five (5) years and the continuation of the District's one-half cent sales tax for five (5) years; and WHEREAS, on May 10, 2014, the duly called and ordered election to consider continuation of the District and its one-half cent sales tax was field, at which election the qualified voters of the District had the opportunity to vote for or against the proposition authorizing the continuation of the District and its one-half cent sales tax.; and WHEREAS, on May 20, 2014, the Board of Directors of the Fort Worth Crime Control and Prevention District adopted a Resolution canvassing the returns and making certain findings concerning the results of said election, a copy of which is attached hereto and made a part hereof, and WHEREAS, under Chapter 363 of the Texas Local Government Code, the District adopted a sales and use tax under Section 323.105 of the Texas Tax Code, for financing the operations of the District in the same manner as a county under that section; and WHEREAS, the 2007 Legislature amended Chapter 363 of the Texas Local Government Code to provide that municipalities are governed by Chapter 321 of the Texas Tax Code; and WHEREAS, pursuant to Section 321.405 of the Texas 'Fax Code, the City Council of the City of Worth is required to declare by resolution the results of said election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCII., OF THE CITY OF FORT WORTH, TEXAS: Section It. That the matters and facts set forth in the Preamble of this Resolution are hereby found to be true and correct. Section 2. That the City Council hereby finds and declares that the election to continue, the District and its one-half cent sales tax for five years was held on May 10, 2014. RTWO Resolution No. 4320-05-2014 Section 3. That the City Council further finds and declares that at said election, the qualified voters of the District were permitted to vote for or against the following Proposition: "WHETHER THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT SHOULD BE CONTINUED FOR FIVE (5) YEARS AND THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT SALES TAX OF ONE-HALF CENT SHOULD BE CONTINUED FOR FIVE (5)YEARS." Section 4. That the City Council further finds and declares that the total votes cast at said election by the qualified voters of the District were as follows: Tarrant County Denton County Total For 12,062 72 12,134 Against 2,191 28 2,219 Section 5. That the City Council further finds and declares the result of the election to be that the Proposition so submitted received a favorable majority vote in all respects and was approved by a margin of 9,915 votes; that pursuant to Chapter 363 of the Texas Local Government Code, the Fort Worth Crime Control and Prevention District is authorized to continue operating within the prescribed boundaries of the District for an additional five years; that accordingly, a local sales tax of one-half of one percent has been authorized to continue for an additional five years; that said tax may continue to be levied and collected as approved by the voters and provided by law to assist in funding the continuation of the District and the carrying out of the District's crime control and prevention plan; and it is so ordered. _Sectiomn 6., That it is hereby officially found and determined that the meeting of the Fort Worth City Council, at which this Resolution was adopted, was open to the public and that public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551 'Of the Texas Government Code.
