HomeMy WebLinkAboutOrdinance 5646 ORDINANCE NO. � AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 6,60 SQUARE MILES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard. on the proposed. annexa- tion of the territory hereinafter described., was held at the City Council Chamber in the City Hall of Fort Worth, Texas, on the 6th day of September, 1966, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published. in a newspaper having general circulation in the City of Fort Worth, Texas, and. in the hereinafter described. territory on the 24th day of August, 1966, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and, WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 391,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 179.860 square miles on January 1, 1966; and WHEREAS, the hereinafter described, territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 6.60 square miles; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed. to the City of Fort Worth, Texas, and said. terri- tory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described., are altered and amended so as to include said, area within the corporate limits of the City of Fort Worth, Texas, to wit: Being all or a portion of the Alexander Albright Abstract No. 1849, William Y. Vickery Abstract No. 1591 Surveys, situated about six miles northwesterly from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a point in the present City of Fort Worth City limit line in the west line of the J. H. Duncan Survey. THENCE along the present City of Fort Worth City Limit Line: south 44 - 46 west 1078 feet; and. south 09 - 37 west 500 feet; and south 13 - 23 west 551 feet, said point being the south corner of the C. H. n Survey; and south 0-08 east along the west line of the Thomas Hicks Survey 866. 9 feet; and south 89-52 west 347.2 feet; and. S0-08 east 591.4 feet, and south 52-15 west 330.2 feet; and south 52-15 west 960.6 feet to a point in the northeasterly line of Ten Mile Bridge Road. (Angle Avenue) , and north 41-15 west along the north- easterly line of Angle Avenue 1650 feet, more or less; and continuing along said line North 56 west 640 feet, and. thence south 45 west along the most westerly line of Buck Sansom Park 1480 feet; and thence south 45 west 1100 feet, more or less, to the southerwesterly,­—, line of Thirty First Streets and. North 45 west 1360 feet, more or less; and south 45 west 1775 feet, more or less; and southerly 650 feet, more or less; and. north 72 west 5,700 feet, more or less; and north 3000 feet, more or less; and west 3415 feet, more or less; and north 2460 feet, more or less; and. east 2100 feet, more or less; and north 2200 feet, more or less; and. northwesterly 1550 feet, more or less; and west 1245 feet, more or less; and north 1743 feet, more or less to a point in the north line of a Texas Electric Service Company right of way in the J. Bowman Survey. THENCE easterly, along the north line of the Texas Electric Service Company right of way, in the Bowman and. A. F. Albright Surveys 17,900 feet, more or less to a point in the present City of Fort Worth Limit Line. THENCE along the present City of Fort Worth City Limit Line; south 2500 feet, more or less; and east 1500 feet, more or less; and northwesterly 5000 feet, more or less; and east 2000 feet, more or less; and southeasterly 5200 feet more or less; and west 480 feet, more or less; and south 1350 feet, more or less; and west 4600 feet, more or less; and southeasterly 1800 feet, more or less; and west 800 feet, more or less; and southerly and southeasterly to a point in the southerly line of the G.C. and S.F. spur track to the Trinity Portland. Cement Plant, and continuing southwesterly along the present City of Fort Worth City Limit Line to the place of beginning and containing approxi- mately 6.60 square miles. SECTION 2. The above described. territory and. the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied. by the City of Fort Worth, Texas, and. the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and. does hereby amend. every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and. its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained.. In response to a request of the City Council, the City Plan Commission has studied the advisability of annexing to the City of Fort Wbrth the Wars Ranch" and adjacent properties. The area considered for annexation is south of Saginaw, bounded by Greenfield Acres Addition on the west, Blue Wund Road on the east, and adjacent to the City of Fort Wbrth on the south, as shown on the attached map. The 6.5 square mile area, now reserved for ,mannexation by the City, will be bisected by Loop 820, contains the Nortb CauTus site of the Tarrant County Junior College District, and will be provided water and sewer service as development is initiated by extension of trunk facilities al,Tezady funded in the Long Range Capital Improvement Program. HistoZZ of Area A portion of the area now under consideration for annexation was previously, included in a Plan Commission recommendation for annexation in a report pub- lished in December of 1962. on June 3, 1963, the City Council annexed approximately 640 of the 1,380 acres then recommended, including the Greenfield Acres Addition and a corridor along Nine Mile Bridge Road and the Boat Club Road. Changes in the area since 1962 were considered by the Plan Commission in its most recent study of annexation needs in theta northwest quadrevat of the metropolitan area. These include four or factors : 1) The City of Fort Wbrth is in a position to extend trunk water and sewer mains, when development warrants, to serve­the area in accordance with standard policies and the long Range Capital Improvement Program. 2) It is anticipated that construction i,-,af the northwest, quadrant of Interstate 820, bringing increased development potential, and rapid appreciation of property values, will be in progress by 1969. 3) Location of the 150 acre North Campus of the 71,,,,ir.ior t,'lollege District within the area is nov underway and will be one of the major urbanizing factors in this area in the near future. 4) Annexation is need6d over a larger area to im°tsure o,r,,derly planning and growth, to avoid installation of sub-standard municipal facilities, and to prevent undesirable ehcroachments which might block development of the area fo r its highest ald best potential uses. DATE REFERENCE SUBJECT: PAGE NUMBER Proposed Annexation 8/8/66 PL-20.8 Northwest Fort Worth indicated that the original annexation proposal should be enlarged to include the contiguous area between Greenfield Acres and the North Industrial Area recently annexed. Nature of Existin& Developme,",nt The area under consideration is now largely undeveloped, except for limited industrial and commercial uses in the vicinity of leacham Field and U. S. Highway 81. Mich of the land area is vacant, used for agricult�ure or for flood control purposes . Marine Lake and Cemen't Creek Lake offer potential for recreational and park purposes as the area develops . Portions of the area located east of Highway 81 have been used previously for grain storage on the ground. There are 28 known property owners in the area, ranging from holdings of one acre to more tbart 2,400 acres, and including 23 personal ownerships, two railroads, an electric utility, water control district, and a Cement industry. Availability of Utilities The Long Range Capital Improvement Program provides for the extension of sanitary sewer and water service into the area proposed for annexation at such time as substantial development warranting the investment in major trunk main facilities is ready to proceed. Marine Creek collector sewer main is completed to the vicinity of 34th Street and Angle Avenue, and ex- tension of the Cement Creek, branch to serve the industrial area on the west side of Meadham Field is scheduled for the Immediate future. Construction of the Marine Creek and Cement Creek collectors as outlined in the Capital Improvement Program will. be scheduled after annexation and as development in the area detiiands . There is an existing water line bordering the south and west side of the proposed annexation area which is sized to serve a large portion of potential development. Another water main is proposed for construction in the Capital Improvement Program, as the need develops from, 38th Street northward in in Street and along U. S. Highways 81 and 287. Sufficient capacity is available in the system. to accommodate immediate future needs of development in the area. Traffic Circulation, and Drainage Few roads now serve the area, but accessibility will be greatly improved when Loop 820 is completed through the area. Neighborhood units and major thorough- fares are outlined in the Preliminary Comprehensive Plan, but the actual con- figuration and cost of streets would be determined by development needs and in accordance with standard policies for the installation of community facilities. The major drainage ways in the area are owned and maintained by the Tarrant County Water Control and Improvement District. Other Municipal Services Fire, police and waste disposal services could be extended from existing routes and facilities located in adjacent sections of the City. Two existing fire stations, Number 12 at 25th and Prospect Streets and Number 15 at Belmont and Odd Streets, are now located within three miles of the area under con- sideration. When. Another new station is scheduled in the Capital Improvement Program for construction near the northwest corner of the area. Annexation Schedule The City Plan Commission favorably considered the annexation of the area described provided City Council action is timed for final annexation after January 1, 1967, thereby delaying assessment for taxes until January 1, 1968, and extending first payment due until January 31, 1969. The Commission also expressed the opinion that consideration should be given to zoning undeveloped portions of the area as "AG-Agricultural" until building activity If the City Council accepts the Plan Commission recommendations, a hearing on the proposed annexation could be held on November 14. First reading could be passed on November 28, and final reading accomplished on January 2, 1967.
