A Resolution NO. 4323-05-2014 AUTHORIZING THE CLOSURE OF A PORTION OF AN ALLEY LOCATED BETWEEN HAWTHORNE AVENUE AND LILAC STREET WHEREAS, the property owners have requested that the City physically close, at the property owners' expense, the public alley lying between Blocks E5 and F6 of Powell's Subdivision located between Hawthorne Avenue and Lilac Street in order to provide security for the property owners and . WHEREAS, the City Plan Commission of the City of Fort Worth reviewed this request at its meeting on March 26, 2014 and recommends that the request be approved. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: That the following portion of the 20 feet wide public alley lying south of Hawthorne Street, located in Blocks E5 and F6 of Powell's Subdivision, an Addition to the City of Fort Worth, Tarrant County Texas, according to the plat recorded in Volume 63, Page 24 of the Plat Records, Tarrant County, containing approximately 0.0459 acres of land more or less, as shown on Exhibits "A" and "B" attached hereto and incorporated herein, be physically closed at each end of the alley described, located between Hawthorne and lilac Street with barricades acceptable to the City's Transportation and Public Works Department,with the City of Fort Worth to retain title to the public night-of-way in said alley, retaining any and all easements for existing and prospective utilities, and retaining the night of access at all times for the purpose of maintaining existing and prospective utility facilities and for emergency access. The City reserves the right, at the sole discretion of the City Council, to reopen by resolution the aforesaid night-of-way to public travel at any time by directing the removal of any barricade or other means of closure, reconstruction of the roadway and the installation of appropriate railroad traffic control devices. This is where the main security challenge for us and our neighbors. Individuals from further down Travis Avenue and Hemphill Street just use the alley as a pass through. Too many non-residents are walking around behind our properties. Some even use the alley and the lots to relieve themselves or dump trash. The empty lot will eventually become a grass/turf covered parking lot in 2014. The alley closure also permits The Bastion to have a proper parking lot already approved by the City with the site plan. I am writing this from the professional opinion of having worked in this area since 3OO5. l was also a burglary detective for this area for 3 years. These alleys serve as azouo of refuge for criminals to eoouye detection while casing for victims. This has impeded the ability of the Bastion restaurant and apartment complex to fully develop their business. There is a constant stream of criminals walking through the middle of their property. This has even caused conflict when these people encountered our own Police and their Explorer volunteer groups. Mv primary recommendation is to plat the o}|cy between the |0uubou"x properties to the Bastion. This would increase tax revenue for the city by making the Bastion's property slightly larger and more valuable, This would doubly improve city budget by reducing the noaiotcn0oco cost for trimming, paving, and otherwise maintaining the alley since it would become part o[osingle parking lot for the Bastion. DISCUSSION: Richard Ricetti has requested the physical closure of this portion of the alley to secure his proposed redevelopment of The Bastion along Hemphill Street. The City Plan Commission recommended approval of this request at its meeting on March 26, 2014. The increased crime adjacent to the applicant's property and repeated vandalism of their security cameras has led the applicant to need a physical barrier to stop non-residential traffic into the alley. There is an included letter of support from the Central Division Neighborhood Police Officer, Sergeant Brent Halford. If this resolution is approved, then the applicant will be required to install gates that meet the requirements of the Transportation and Public Works Department. The City will retain title to the public right-of-way in the alley, retain any and all easements for existing and prospective utilities, and retain the right of access at all times for the purpose of maintaining existing and prospective utility facilities and for emergency access.
