HomeMy WebLinkAboutOrdinance 7529ORDINANCE NO. 7 S Z 9 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE 3500 BLOCK OF KENT STREET BEING A WIDTH OF 50' AND EXTENDING ALONG THE SOUTH BOUNDARY LINE OF LOTS E AND D-2, BLOCK 22, BELLAIRE ADDITION, A LENGTH OF 243'. AND, EXTENDING ALONG THE NORTH BOUNDARY LINE OF TRACT 2 OF THE J. SMITH SURVEY, ABSTRACT 1383 (TEXAS CHRISTIAN UNIVERSITY CAMPUS) A LENGTH OF 290'; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH AND PROVIDING THAT THIS ORDINANCE SHALL; BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That a portion of the 3500 Block of Kent Street being a width of 50° and extending along the south boundary line of Lots E and D-2, Block 22, Bellarie Addition, a length of 243'. And, extending along the north boundary line of Tract 2 of the J. Smith Survey, Abstract 1383 (Texas Christian University Campus) a length of 290° be and the same is hereby vacated, abandoned and permanently closed as a right-of-way for street purposes. SECTION 2. That the fee to the land in the above described street right-of-way is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved therein for any and all existing utilities including existing sanitary sewer facilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. Birdsong, with the consent of Texas Ch~•istian University and H.Fo and .,~~~, Virginia Hopkins, owners of all abutting property, has requested that the City vacate Kent Street in the 3500 Block a width of 50 feet and a length variable to 290 feet. The subject right-of-way, acquired by dedication, is neither paved nor open, but contains sanitary sewer facilities A f~su~r-~~ar garage encroaches in the western end of the subject right-of-way. '. Approval of this request will dead end the right--of-way for Kent Street at the east line of Lot D-2, and leaving a blesck length in excess of 600 feet. How- ever, the existing roadway tu5:ris before this point and continues south into Texas Christian University property as a private street. Thus, vacation of the subject right-of-way will not close an existing street access, and a turn-around or cul-de-sac at the dead end is apparently unnecessary. The City Planning Commission reviewed this request and recommends approval sub- ject to a replat showing necessary easements for a drainageway and sanitary sewer crmssing the property. The Commission also waived the requirement for a cul-de-sac to turn-around at the east end of the remaining Kent Street right- of-way. A satisfactory re-plat has been submitted Recommendation It is recommended that an ordinance be adopted vacating the subject right-of- way as requested.
