AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 49,s CHMSERLIN ARLINGTON HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS., BE ABANDONED., VACATED AND CLOSED; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND. WHEREAS, it appearing to the City Council of the City of Fort Worth that the alley in Block 49, Chamberlin Arlington Heights Addition to the City of Fort Worth, Tarrant County, Texas, has never been used by the public and that it is to the best interest of the public that said alley be closed, abandoned and vacated as a public thoroughfare and the fee to the land in said alley revert as provided by law; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley in Block 49,, Chamberlin Arlington Heights Addition to the City of Fort Worth, Tarrant County, Texas, be and the same is here- by vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever, SECTION 2. That the fee to the land in said alley above described is hereby re- leased and will revert to the owners as provided by law, save and except that an easement is reserved for all existing public utilities. SECTION 3, That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4, That this ordinance shall take effect and be in full force and effect. from and after the date of its passage. Luther and Nancy Luther Wilson, joined by their respective husbands, A. C. Luther and Earl API'Ll- son, Jr. , and General Lumber Company, a Texas corporation, act- ing by and through R. Williams, its duly authorized secretary and treasurer, each owning a part of Block 49, Chamberlain- Arlington Addition to the City of Fort Worth, Tarrant County, Texas, and together owning all of such block, do hereby petition the City Council of the City of Fort Worth for an order closing the east-west alley through said Block 49, and respectfully represent: That such alley is in fact now and has been since its dedication a private alley, and that no public interest is in- volved; that petitioners own all of the property which abuts upon and composes said private alley, and that the nature of the existing and contemplated improvements and developments in said Block 49 and in the surrounding area and the contemplated -widening of Camp Bowie Boulevard have brought about a situation necessitating the closure of such alley and the removal of utilities therefrom so that the owners of said Block 49 may erect buildings and improvements on, over and across said former alley in order to fully utilize and enjoy the benefits from their respective properties and so that such properties may be devoted to their highest and best use. Petitioners further represent that said private alley- way has never been actually opened, used or accepted for travel, and that the closure of same will be for the best public inter- est, in that it will increase the value of the use and conse- quent future tax value of such property by allowing suitable buildings to be erected thereon by the respective owners , and that the closure of such alley has been further necessitated by the plan and program of the City of Fort Worth and other govern- ing authorities to widen Camp Bowie Boulevard and thus require improvement set-backs and loss of use by such owners of a wide strip along the south lines of their said respective properties so that if such set-backs are to be observed, such owners now require the full use of the remainder of the lot for high grade development consistent with and suitable for that location. VII-IEREFORE, petitioners pray for an order of closure , and such other orders for the removal of utilities as may be appropriate in the premises .
