ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE
COST OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED
FOR IMPROVEMENTS ON A PORTION OF ,SEMINARY DRIVE IN
THE CITY OF FORT WORTH, TEXAS, FIXING TIME AND PLACE
FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND
OWNERS OF RAILWAYS AND TO ALL OTHERS INTERESTED,
AND DIRECTING THE CITY SECRETARY TO GIVE NOTICE.
WHEREAS, the City Council of the City of :Fort Worth,
Texas, has heretofore ordered that the hereinafter described
portion of Seminary Drive in the City of Fort Worth, Texas,
be improved by raising, gradinC and filling same and by con-
structing thereon a. 10 inch flexible base course, with a 3;
inch Hot Mix Asphaltic Concrete Base on top of said flexible
base and by surfacing same with a 11 inch Hot Mix Asphaltic
', Concrete Surface, and by constructing combined concrete curbs
and. gutters on proper grade and line where same are not already
so constructed, together with storm sewers and drains and other
' necessary incidentals and appurtenances; all which said improve-
iments shall be constructed as and where shown on the plans and
in strict accordance with the plans and specifications therefor,
land contract therefor has been made and entered into with
;Texas Bitulithic Company; and,
WHEREAS, the City Council of the City of Fort Worth,
Texas, has caused the Public Works Director to prepare and file
estimates of the cost of such improvements, estimates of the
amounts per front foot proposed to be assessed against abutting-
property and the owners thereof, and amounts to be assessed.

feet on each side thereof, and such estimates have been
examined, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS, THAT:

Such estimates be, and they are hereby, adopted and
approved.
It is hereby found and determined that the cost of
i,improvements on the hereinafter described portion of Seminary
iDrive, with the amount or amounts per front foot proposed to be
assessed for such improvements against the abutting property
Uand the owners thereof and the amount to be assessed against
,railways for improvements in the area between and under rails,
tracks, double tracks, turnouts and switches, and two feet on
each side thereof, are as follows, to wit:
On SEMINARY DRIVE, from the easterly line of McCart
Avenue to the westerly line of South Adams Street: the estimated
cost of the improvements is ° eF ,A.�, the estimated amount
per front foot to be assessed agginst abutting property and the
;owners thereof for curb and gutter is �, � the

its roadbed, ties, rails, fixtures, rights and franchises,
using, occupying and/or crossing said portion of Seminary Drive,
for improvements in the area between and under rails, tracks,
j double tracks, turnouts and switches and two feet on each side }
thereof, is the estimated cost of the improvements in such area,

A hearing be given and held by and before the City J
Council of the City of Fort Worth, Texas, to all owning or
claiming any property abutting upon said portion of Seminary
Drive and to all others ownina or claiming any interest in any
such property and to the owners of railways, street railways
and interurbans, using, occupying and/or crossing; said portion
of Seminary Drive and to all others owning or, claiming any
interest in any such property. Such hearinE shall be given
and held on the " .2- day o.f A. D., 1955, at
r" ' o'clock,_�- Nf,°r in the Council Chamber in
the City Hall in the City of Fort orth, Texas, and the City
Secretary is hereby directed to give notice of the time and
place of such bearing and of other matters and facts in accord-
ance with the terms and provisions of the Act passed at the
First Called Session of the Fortieth Legislature of the State
of Texas, known as Chapter 106 of the Acts of said Session, now
shown as Article 1105b of Vernon's Texas Civil Statutes, which
, Act has been adopted as an amendment to and made a part of the
'! Charter of the City of Fort Worth, Texas. Such notice shall
be by advertisement inserted at least three times in a newspaper
published in the City of Fort Worth, Texas, the first public-
ation to be made at least ten (10) days before the date of said
hearing and said notice shall comply with and be in accordance
with the terms and provisions of said Act.
