ORDINANCE ACCEPTING I14PROVEMENTS ON A PORTION OF NORTHWEST 21st STREET
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH
TEXAS BITULITHIC COMPANY FOR THE CONSTRUCTION OF SAID
IMPROViiffENT3 FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS-
K&NTS LEVIED AFTEA GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY
SECRETARY TO ENGROSS AIM ENROLL THIS ORDINANCE BY COPYING THE CAP-
TION OF SAME IN THE 1AINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH,
TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with Texas Bitulithic Company for the snaking and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public
places in said City, to-wit:
NORTHWEST 21st STREET: From 140 feet east of the east line of Roosevelt
Avenue to North Main Street, known and designated as
Unit No. 2, a 2-inch hot-mix asphaltic concrete surface
on an 8-inch cement stabilized gravel base on a
40-foot roadway.
WHEREAS, by sundry proceedings heretofore assed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. M4 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
M&-LEAS, the City Council of the City of Fort �iorthp Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 5254 . and
WHEREA5, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
I.
The improvements on each of the portions of streets,, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
Ii.
The Mayorp be, and he is herebyp directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed andshall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:
When each of the certificates has been duly executed as hereinabove provid-
ed, same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

portions of Denver Avenue Relief Storm Drain were completed.

Attached is a tabulation of -paving test cores showing compliance with
specifications,, within construction tolerance on Northwest 21st Stroet,
widening andimprovements from Roosevelt Street, to North Main Street.
From Ellis Street to North Main Street, the asphaltic surface was
placed on, the existing concrete, base. The base in t1iis area is not a
part of this contract.
During testing on this protect, 53 surface corings an& 50 base corings
were made with the following results!

On this entire project the average thickness of the base course is
8.50 inches as compared to 8.0 inches specified and Hot Mix Asphaltic
Surface is 2.25 inches as compared to 2.0 'inches specified. Tests
made daring construction of sub.-grade, base and pavement show that
material used', was in compliance with specifications.
Recommended Council Action
It is recommended that the above project be accepted by adoption of an
ordinance and that final payment of $10,252.88 be authorized to Texas
Bitulithic Company.
