HomeMy WebLinkAboutOrdinance 5647 ' ~ . . . ^ ORDINANCE N0. `* AN ORDINANCE AMENDING ORDINANCE NU. 3011 , BEING AN ORDINANCE TO REGULATE AND T0 RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCES, OR OTHER PURPOSES; THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDING; AND OTHER STRUCTURES: THE SIZE OF YARDS AND OTHER OPEN SPACES; OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NU' SUl]; PRESCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED T0 EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION |' That Ordinance No. 3011 be amended so that the following described uses in the hereinafter described area be altered, changed and amended as follows to wit: Z-66-81 Tract 2 and a portion of Tract 3D of the K. Biusett Survey, more fully described as follows: Being a part of the Robert BisseLt Survey, Abstract No. 193, Tarrant County, Texas, and being more particularly described as follows: Beginning at a point in the south line of said 8issett Survey and in the east line of Roaring Springs Road, said point being 801 feet easterly from the southwest corner of said survey; Thence northerly with the easterly line of Roaring Springs Road with the following courses and distances: N 0"51' E, 40,0 feet; N 1"42' E. 1041 .0 feet to the beginning of a curve to the left with a radius of 766'2 feet, and then along said curve to the left for a distance of 396.9 feet to the end of said curve; and then N 27"56' W, 481.2 feet to the intersection of said line with the South line of Vnlder Avenue; Thence easterly with the southerly line of Volder Avenue with the following courses and distances: N 52"01 ' E, 3.5 feet to the beginning of a curve to the right whose radius is 179.84 feet; and then along said curve to the right for o distance of 88.2 feet to the end of said curve; and then S 89°46' E, 802.8 feet to its intersection with the northeasterly line of an original 67-anra tract described in Vol . 1910, page 229, of the Deed Records of Tarrant County, Texas; Thence S SO" 16 E with said northeast line 357.4 feet to the easterly northeast corner of said 67-acre tract, said point being the most northerly corner of tract described in Vol. 2220, page 79 of the Deed Records of Tarrant County, Texas; Thence southeasterly with the northeast line of tract with the following courses and distances: S 50012' E, 784.0 feet; S 52°2O' E, 300.0 feet; 3 57"13' E, 300.0 feet and 5 62°05' East, 123.2 feet to the most northerly northeast corner of said tract; Thence continuing with the boundary line of said tract as described in said Vol. 2220, page 79; S 16"26' W. 237.8 feet and North 71°14' W, 230.0 feet, to a re-entrant corner of said tract; Thence in a northwesterly direction for a distance of approximately 1280 feet to an angle point on the boundary line between said tract described in Vol. 2220, page 79, and the said 67-acre tract described in Vol. 1910, page 228, of the Deed Records of Tarrant County, Texas, said point being South, 456'2 feet and S 60"38' W, 298.7 feet from the said easterly northeast corner of said 67-acre tract and the north corner of said tract described in Vol, 2220, page 70 of the Deed Records of Tarrant County, Texas; Thence along the southeasterly line of said 67-acre tract and along the southeast hank of a branch with the following courses and distances' � 30"40' W 259 0 feet; 3 22°5g' W l3O 6 feet; 3 26°56' . , . , . The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general Welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public require- ments. They have been made after a full and complete public hearing with reasonable considera- tion among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be in- valid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. _ Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and Nu/100 Dollars ($200.08) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6._ This ordinance will take effect and be in full force and effect from and after its passage and publication as required by law. APPROVED AS T0 FORM AND LEGALITY: CITY ATTORNEY Adopted
