ORDINANCE NO. 21253-05-2014
AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
THROCKMORTON STREET AND 12TH STREET, SITUATED IN THE J.
CHILDRESS SURVEY, ABSTRACT NO. 250, FORT WORTH, TARRANT
COUNTY, TEXAS, AS RECORDED IN THE DEED RECORDS OF
! TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION-OF FEE
IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
` BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.

That portions of Throckmorton Street, a variable width right-of-way, and 12th Street, a

variable width right-of-way, situated in the J. Childress Survey, Abstract No. 250, as shown on
G the plat of Daggett's Addition, an unrecorded addition to the City of Fort Worth, Tarrant County,
Texas as recorded in the Deed Records of Tarrant County, Texas, and containing approximately

0.057 acres of land more or less, and as more specifically described in Exhibits "A" and `B"
attached hereto and incorporated herein by reference be and the same is vacated and

extinguished.

SECTION 2.
!i That the fee to the lai ids in the above-described vacated alleys and streets are hereby
released and shall revert to the adjacent owner as provided by law.

SECTION 3.

' That all existing utility easements shall be retained by the City until such time all utilities

located in the easements are re ocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a tract of land situated in the J.Childress Survey,Abstract No.250,Tarrant County,Texas and being a
portion of Throckmorton Street and 12`h Street as shown on the plat of Daggett's Addition,an unrecorded addition
to the City of Fort Worth,Tarrant County,Texas and being more particularly described by metes and bounds as
follows(bearings referenced to the south Iine of Lot 1,Block T,of said Daggetts Addition):
' BEGINNING at a found 5/8 inch capped iron rod marked"BHB INC"in the common line between said 12°i Street

and Lot 1,Block T,same being at the beginning of a curve to the left;
THENCE along the arc of said curve to the left,having a central angle of 81°53'23",a radius of 110.00 feet,an arc
length of 157.22 feet and a chord which bears North 19°02'46"East,a distance of 144.17 feet to a found 5/8 inch
capped iron rod marked"BHB INC",same point being in the west right-of-way line of the aforesaid Throckmorton

Adopt Ordinance Vacating a Portion of Twelfth Street and a Portion of Throckmorton Street Excess Rights-
; of-Way to be Replatted with the Adjoining Property Owned by the Catholic Diocese of Fort Worth for
Additional Parking and Landscaping (COUNCIL DISTRICT 9)

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Twelfth Street and a portion of Throckmorton Street
excess rights-of-way to be repiatted with the adjoining property owned by the Catholic Diocese of Fort
i Worth for additional parking and landscaping; and
i
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (Mayor and
Council Communication G-15624).

DISCUSSION:
Baird Hampton and Brown, Inc., on behalf of the Catholic Diocese of Fort Worth, has requested the
vacation of these portions of rights-of-way to replat them with the adjoining property for additional parking
and landscaping. The City Plan Commission recommended approval of this request at its meeting on
March 24, 2010. An acceptable final plat (FS-011-118) has been received in accordance with the
Subdivision Ordinance.

The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting
process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easements for the streets and alley.
This project is located in COUNCIL DISTRICT 9, Mapsco 77A.

funds.
