ORDINANCE NO._J r AN ORDINANCE VACATING, ABANDONING AND CLOSING A 10 FOOT UTILITY EASEMENT ALONG THE COMMON LOT LINES OF LOTS 9A and 9B, BLOCK 12, RIDGLEA HILLS ADDITION, FROM A POINT 5 FEET SOUTHEAST OF THE NORTHWEST LOT LINES OF LOTS 9A AND 9B, BLOCK 12 TO CLAYTON ROAD EAST, A DISTANCE OF 178.28 FEET, AS SHOWN IN VOLUME 388-118, PAGE 42 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS;. PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the 10 foot utility easement along the common lot lines of Lots 9A and 9p, Block 12, Ridglea Hills Addition, from a point 5 feet southeast of the northwest lot lines of Lotg 9A and 9B, Block 12 to Clayton Road East a distance of 178.28 feet, as shown in Volume 388-118, Page 42 of the Plat Records of Warrant County, Texas, be and the same is hereby vacated, abandoned and permanently closed as a utility easement. SECTION 2. That the fee to the land in said utility easement is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Porter, owner of Lots 9A and 9B, Rid8lea Hills Addition, has requested that the City vacate the 10 foot utility easement along the common_ lot lines of Lasts 9A and 9B, Block 12, Rid,8lea hills Addition, from a point 5 feet southeast 4f the northwest lot: lines of Leets 9A and 9B, Black 10, to Clayton Read East a distance of 178.28 :feet, as shown n the attached maps. The subject easement was acquired by dedication, but contains no utilities. City departments and private utility companies have reviewed this request and recommend approval as submitted. Recommendation It is recommended that an ordinance be adapted vacating the subject ease- 'meat as requested.
