AN ORDINANCE REGULATING TURK ON P0LIC STREETS, ALLEYS AND THOROUGHFARES; PROVIDING FOR A LICENSE AND BOND AND PERMIT TO WORK ON PUBLIC STREETS; PROVIDINGFOR REVOCATION OF' LICENSE PDR VIOLATING THE ORDINANCE OR 11INI UM STANDARDS OF QUALITY CF WORK: PRESCRIBING A PENALTY FOR VIOLATION THEREOF. SECTION 1. It shall be hereafter unlawful for any person, firm or corporation to lay, construct, build, repair, rebuild, grade, gravel, pari:, surface, resurface or do any work in or upon any public street, alley, or thorou h- fare within the corporate limits of the City without first having obtained from the Director of IAO1lic IwIorks a license to 6) such work without having paid a license fee to the City in the annunt of One Hundred Dollars ($100.00), having made and executed a bond to the City in the sum of Five Thousand fal- lars ($5,000.0o) and without hawing obtained a permit from the Director of Public Works of the City to do the specific work contemplated. SECTION 2. The license required by the preceding section of this ordinance shall be issued and approved by the Director of Public Norks. Before the issuance of same, the applicant shall file in the office of the Director of Public, hbrks a detailed statenwnt of the apml':ulicantts qualifications, together with a surety company bond in the amount of Five Thousand Dollars 05,000.00), con- ditioned that the applicant will indemnify and save whole and harmless the City from any and all darftRgea of any character arising from or caused directly or indirectly by any negligence in the performance of such work, and for any imperfect or inadequate work done by the applicant and further conditioned that applicant will maintain such work in a ;food and workmanlIke manner and state of repair for a period of two (2) years 1,raam and after Its completion and acceptance by the City. Such statement of qualifications approved by the Director of Public Works, together with bond, license number and date of issuance, shall be filed by the Director of Public Works with the City Secretary. 1 The applicant shall also state in his application for a license, his place of business, the names of his aaaociates in such business and the name and address under which the business is to be transacted. Each licensee shall notify the Director of Public Works immediately of any and every change of address or style of his firm. All such licenses shall be in force from the date of issuance until revoked by the Director of Public Works as hereinafter provided. Such license may 1�e revoked by the Director of Public Works for violation by the licensee of any provision of this ordinance, for failure of licensee to have an appro,ved bond in force at all times as aforesaid, or for failure of the licensee to complete any specific work in conformity to the plans and specifications for which any permit may be granted to licensee. The licensee shall not permit the use of such license for any person, other than his employees, for the purpose of doing any work covered by this ordinance, nor shall he sub contract to any other person, firm or corporation any work for which a license is issued to him. In addition to the license or bond he-rein required, it shall be unlaw- ful for any person, firm or corporation to lay, construct, build, repair, re- build, grade, gravel, pave, surface, resurface, or do any work in or upon any public street, alley or thoroughfare within the corporate limits of the City without having first secured from the Director of Public Works a permit to do the specific work contemplated. The licensee shall notify the Director of Public Works of the date an which he intends to commence the work for which the permit is sought. SE'CTION 3. This ordinance is intendecito be cumulative of other ordinances pre- sently in existence, and is not intended to repeal any ordinance or part of an ordinance not in direct crud express conflict herewith. This ordinance, shall not be construed to prevent any person flria or corporation from doing work In a public street, alley. or thoroughfare under authority of either a cement contractor's license and bond or a plumbing license or bond. reo SECTION 4. Any person, group of persons, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and punished by a. fine not to exceed Two Hundred Dollars ($200.00).
