HomeMy WebLinkAboutOrdinance 21286-06-2014 Ordinance No. 21286-06-2014 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $2,900,000.00 SUBJECT TO RECEIPT OF A GRANT FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, FOR THE PURPOSE OF THE HOUSING AND ECONOMIC DEVELOPMENT DEPARTMENT'S LEAD HAZARD REDUCTION DEMONSTRATION GRANT PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the Budget of the City Manager,there shall also he increased estimated receipts and appropriations in the Grants Fund in the amount of$2,900,000.00, from available funds, for the purpose of the Housing and Economic Development Department's Lead Hazard Reduction Demonstration Grant Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall he and remain in frill force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the application for and, if awarded, the acceptance of a grant of up to 0,000.00 from the United States Department of Housing and Urban Development consisting of up to $2,000,000.00 for a Lead Hazard Reduction Demonstration Program and up to $400,000.00 for a Healthy Homes Supplemental rant; 2. Authorize the use of up to $500,000.00 of Community Development Block Grant funds as the City's direct match; . Authorize the City Manager or his designee to r into related r t and commitments and to amend or extend such Agreements and commitments as may be necessary and appropriate within the scope of the program and in compliance with applicable laws and regulations govrnin the use of federal rant funds; . Certify that the activities to be funded with the grant are consistent with the City's Consolidated Plan; and 5. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund in the amount up to $2,900,000.00, subject to receipt f the grant. DISCUSSION: On May 13, 2014, the United States Department of ousin and Urban Development (HUD) issued a Notice of Funding Availability for competitive rant funds under the Lead Hazard Reduction Demonstration Program (L ) and the Office of Healthy Homes Supplemental Funding Program (HHSF). The purpose of the LHRD and the HHSF programs is to assist local governments in rti programs to identify and control lead-based paint hazards in owner-occupied os and privately owned rental housing. Housing is generally made lead-safe through the use of interim controls, a cost-effective treatment consisting of encapsulation of lead-paint surfaces and replacement of components such as doors and windows which have friction surfaces that can create lead dust. The HHSF grant is to be used Lo c: 17L,EAD HAZ_ARD REDUCTION DEMONSTRATION GRANT 2014 Page I of 2 in conjunction with the LHRD grant on the same house in order to eliminate health ands t hazards identified during the lead-based paint inspection. Hazards are defined by the HHSF rating system and may include uneven flooring surfaces, trip hazards in bathrooms, poor lighting, moisture problems, exposure to carbon monoxide, fire hazards, excessive heat or cold exposure, exposure to biocides and non-secured entry ways. The City's Housing and Economic Development Department received similar LHRD grants in 2002-2005, 2005-2008 and most recently in 2012 for the Lead-Based it Hazard Control Grant Program which expires in May of 2015. This grant funding under the LHRD Grant Program will expand the City's efforts to increase the supply of lead-safe housing. This is the first time the it is applying for the HHSF program. The Housing and Economic Development Department is requesting authorization to apply for a $2,000,000.00 LHRD grant and a $400,000.00 HHSF grant from HUD. The grant period will be for three years from the date of the award. Administrative costs for the program are limited to 10 percent of the grant. The grant requires a minimum 25 percent direct match and Staff proposes that $500,000.00 of the City's Community Development Block Grant funds be used for this purpose. The use of these funds for this purpose will be approved in the 2014-2015 Action Plan. The Housing and Economic Development Department will collaborate with the Tarrant County Public Health Department, area non-profits, community-based organizations and other entities to ensure that appropriate outreach is conducted on all at-risk populations and neighborhoods. The LHRD and HHSF Programs will be available in ALL COUNCIL DISTRICTS.
