ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF hTzRRICK STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH d.E. BRITTAIN, INC. FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS— MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP— TION OF SAME IN THE MINUTE BOOK OF THE, CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE- COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with 4.E. BRITTAIN, INC. for the making and construction of certain street improvements on the hereinafter described portions Of streets, avenues and public places in said City, to—wit.- 1. &','F,`RRICK STREET: From West Freeway to Bryce Avenue, known and designated as Unit No. 1. 2. GUILFORD ROAD: From lAdlvey A',venue to Camp Bowie Blvd., known and designated as Unit No. 2. 3. vVESTOLIFF RC,AL,' SOUTH: From Bellaire Drive West to West end of street, known and designated as Unit No. 3. 4. HILLTOP 4;00: From Bellaire Drive ',4est to West end of street, known and designated as Unit No. 4. 5. NMART STREET-. From Seminary Drive to 300 feet South of Gambrell Avenue, known and designated as Unit No. 5- 6. PARKHILL DRIVE: From Stadium Drive to Nabash Avenue, known and designated as Unit No. 6. 7. MISSISSIPPI AVENUE: From East Berry to the South 180 feet, known and designated as Unit No. 7. WHEREAS, by sundry proceedings heretofore passed� the City Council of the City of Fort Worth, Texas, including Ordinance No,5241 & 55,22 portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, YdHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No, 5241 & 5251 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THE,RLFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXr1S, THAT I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed, II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments, The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after diving effect to such credit, if any, are hereby enumerated and itemized as follows- Its. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as .part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. During testing on this project, 63 curings were made with the follow- ing results : Exceeds Even With Under Specs But Below Pavingi2i—cs— UiSL_ Within Tolerance Tolerance Surface 63 3 2 0 Base 66 2 0 0 On, this project, the, average base course IS 8.17 inches as compared to, 7.0 inches specif fed, and hot-avix asphaltic surface is 2.1. E inches as compared to 1.5 inches specified. Tests made during construction of the sub-base, base and pavement also show that the material used was in compliance with specifications'. Lecormpended Council Action It is recommended: 1) Viat a Bond Fund Transfer of $1,373.90 be approved from Project No. 094-27000-901 to Project No. 0194-27000-115 to provide additional funds for the project. 2) That the above project be accepted by adoption of an ordinance and that final payment of $9,805.76 be authorized to W.
