HomeMy WebLinkAboutOrdinance 21287-06-2014 Ordinance No. 21287-06-2014 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER OPERATING FUND IN THE AMOUNT OF $7,511,318.20, SUBJECT TO RECEIPT OF A TRANSFER FROM THE STATE REVOLVING FUND, FOR THE PURPOSE OF REIMBURSING THE WATER AND SEWER OPERATING FUND FOR PAYMENTS MADE IN SUPPORT OF THE STATE REVOLVING FUND PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Water and Sewer Operating Fund in the amount of$7,511,318.20, subject to receipt of a transfer from the State Revolving Fund, for the purpose of reimbursing the Water and Sewer Operating Fund for payments made in support of the State Revolving Fund program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer in the amount of$7,511,318.20 from the State Revolving Fund to the Water and Sewer Operating Fund; . Authorize the transfer in the amount of ,147.85 from the State Revolving Fund to the State Revolving Debt Service Fund; and . Adopt the attached supplemental appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Operating Fund in the amount of$7,511,318.20. DISCUSSION: The Water Department participates in the State Revolving Fund loan program administered by the Texas Water Development Board to fund plant expansion projects and improvements to existing facilities through issuance of revenue bonds. In the past, bond-issuance costs that are now regularly paid from a portion of the bond proceeds at the time the bonds are issued were instead paid in advance by the Water and Sewer Operating Fund. One purpose of this Mayor and Council Communication ( ) is to take actions to reimburse the Water and Sewer Operating Fund for $6,412,622.41 in past expenditures for bond-issuance costs relating to the State Revolving Fund program. The M&C also proposes returning $1,098,695.79 to the Operating Fund that originally came from that fund, resulting in total of$7,511,318.20 being transferred to the Water and Sewer Operating Fund. The other purpose of this M&C is to transfer the remaining 0,147.85 to the State Revolving Debt Service Fund in accordance with the ordinances that authorized the bonds since all costs associated with the projects have been paid and the projects completed. The Texas Water Development Board staff has reviewed and approved the repayment of the issuance costs and has indicated that the Water Department may spend the remaining funds as it sees fit.
