SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO. 44376,
A PROFESSIONAL SERVICES AGREEMENT WITH SUSAN ALLEN KLINE
THIS SECOND AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 44376
("Second Amendment"), as amended, is made and entered into by and between the City of Fort Worth,
Texas, a home-rule municipal corporation of the State of Texas ("City"), acting by and through its duly
authorized Assistant City Manager, and Susan Allen Kline ("Consultant"), a natural person and Texas
Historic Preservation Consultant.
WHEREAS, on March 18, 2013, the City and Consultant entered into City Secretary Contract
("CSC") number 44376, a professional services agreement for in which the Consultant agrees to perform
extensive research and preparation and possible publication of a manuscript on the history of the City of
Fort Worth Parks and Community Services Department provisionally entitled, "History of Fort Worth
Parks";
WHEREAS, on May 7, 2014, the parties executed an amendment to the Contract increasing the
scope of work to include the brief histories of approximately 130 additional parks for inclusion into
Chapter 8: Park and Recreation Facilities of the Commissioned Work and compensation to twenty-two
Thousand Dollars ($22,000.00), said agreement being CSC No. 44376-A 1;
WHEREAS, both parties wish to adjust the Schedule for Delivery and Payment Schedule set
forth in Exhibit A to allow for the additional time necessary to complete the Commissioned Work;
WHEREAS, Consultant desires additional time to complete the remainder of the Commissioned
Work,extending the term to September 30, 2014
NOW, THEREFORE, in consideration of the mutual covenants and agreements contained
herein, the City and the Consultant do mutually covenant and agree to amend CSC No. 44376, as
amended by CSC No. 44376-A1 (collectively, the"Contract"), as follows:
I.
Exhibit B of the Contract, which details the delivery and payment schedules for the
Commissioned Work, is hereby replaced with the exhibit attached to this Second Amendment as Exhibit
B. The attached Exhibit B is hereby incorporated into the Contract for all purposes and supersedes any
prior Exhibit B. All references to Exhibit B in the Contract shall refer to the attached Exhibit B.
H.
All terms and conditions of the Contract that are not expressly amended pursuant to this Second
� Amendment shall remain in full force and effect.
III.

All terms in this First Amendment that are capitalized but not defined shall have the meanings

`City may pay Consultant coaatin envy fiends in an amount not to exceed $1,500.00, at an hourly rate of Seventy
Dollars ($70„00), for unforeseen costs associated with the Commissioned Work. The Consultant must seek prior
written approval from the City's Parks and Community Services Director or that persons designee before
incurring any costs against the contingency funds.
