ORDINANCE NO.21284-06-2014
I AN ORDINANCE AMENDING CHAPTER 2 (ADMINISTRATION),
ARTICLE I (IN GENERAL), SECTION 2-9 (CONTRACT EXECUTION;
AMENDMENTS; CHANGE ORDERS) OF THE CODE OF THE CITY OF
FORT WORTH, TEXAS (1986), AS AMENDED, TO AUTHORIZE THE
CITY MANAGER TO EXECUTE STORMWATER FACILITY I
MAINTENANCE AGREEMENTS; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE; PROVIDING FOR A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Section 2-9 of the City Code currently authorizes the City Manager to execute
certain City contracts without the approval of the City Council; and
WHEREAS, the City of Fort Worth requires responsible parties to execute agreements
for the construction of drainage improvements and the maintenance of drainage improvements
and any existing or natural drainage systems that remain in use prior to causing any activity that
disturbs the land;
WHEREAS, in order to expedite the process for executing stormwater facility 4
maintenance agreements to private land development projects, and consistent with the City
Council's past actions granting administrative authority for certain contract execution to the City
Manager, the City Council wishes to amend Section 2-9 of the City Code to grant to the City
Manager the authority to execute stormwater facility maintenance agreements.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH,TEXAS:

SECTION 1.
Chapter 2 (Administration), Article I (In General), Section 2-9 (Contract execution; j
amendments; change orders) is hereby amended to add to Section (d), a new subsection to read as
follows: '
(d) The city manager may execute the following without city council approval:

(11) Any contract or other legal instrument for the construction and/or
maintenance of a stormwater management facility in accordance
with all standards and ordinances then in force and effect.
All other elements of Section 2-9 shall remain unchanged.
SECTION 2.

This ordinance shall be cumulative of all provisions of ordinances of the Code of the City of j
Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in which event conflicting
provisions of such ordinances and such Code are hereby repealed.

It is hereby declared to be the intention of the City Council that the sections, paragraphs, �44
sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, I
paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or i
unconstitutionality shall not effect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such void, ineffective or unconstitutional phrase, clause,
sentence,paragraph or section.
SECTION 4.

This ordinance shall take effect and be in full force and effect from and after its passage,
and it is so ordained.
