AN ORDINANCE AMENDING, CHAPTER 35, "WATER AND SEWERS"
OF THE CODE OF THE CITY OF FORT WORTH (1986), AS
AMENDED, BY AMENDING ARTICLE III, DIVISION 3, "SEWER PER
ACRE CHARGES", SUBSECTION 35-82 (d) AND SUBSECTION 35-83
(a); AND AMENDING, ARTICLE III, DIVISION. 4, "WATER MAIN
CAPACITY CHARGES", SUBSECTION 35-88, DEFINTION OF
DEVELOPER-INITIATED APPROACH WATER MAIN, AND
SUBSECTION 35-92 (3) TO REMOVE THE LENGTH AND SIZE OF PIPE
REQUIREMENT; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.

WHEREAS, on May 14, 2002, the City Council adopted the Sewer Per Acre Charges as i
Article III, Division 3 to Chapter 35 of the City Code by City Ordinance No. 15095;
and !
WHEREAS,- on June 19, 2007 the City Council adopted the Water Main Capacity
Charges as Article III, Division 4 to Chapter 35 of the City Code By City Ordinance No.
17623; and

WHEREAS, the purpose of the Sewer Per Acre Charge and Water Main Capacity Charge is to
allow developers and the city to recoup costs related to the construction of the water and
sanitary sewer extensions; and
WHEREAS, currently there is a length and size restriction on pipes allowable for
reimbursement under the provisions in the City Code addressing Sewer Per Acre Charges and
Water Main Capacity Charges; and

WHEREAS, the Water Department has determined that it is necessary to remove the pipe
length and size restrictions to allow for the reimbursements of the charges; and

WHEREAS, the Water Department has also determined that it is also necessary to include fire
flow in the water main capacity charge by using net capacity in the calculation of such charge;
and
WHEREAS, on January 27, and February 24, 2014, the Water Department presented these
amendments to the City Code to the City's Development Advisory Committee who concurred
with the Water Department's recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH,TEXAS:

SECTION 1. I

Part II of the Code of the City of Fort Worth, Texas (1986), as amended, Chapter 35, "Water
I
and Sewers", Article III "Charges", Division 3, "Sewer Per Acre Charges", Section 35-82,
"Definitions" subsection (d) is hereby further amended to be as follows:
(d) City initiated sewer main shall mean any sewer main constructed by the city
regardless of the length and size of pipe constructed or the size of the sewer basin.

SECTION 2.

Part II of the Code of the City of Fort Worth, Texas (1986), as amended, Chapter 35, "Water
and Sewers", Article III "Charges", Division 3, "Sewer Per Acre Charges", Section 35-83,
"Criteria for per acre charge sewer mains; developer initiated project" is hereby amended to be
as follows:

Section 35-83. - Criteria for per acre charge sewer mains; developer initiated project.
A per acre.charge may be collected for an Approach sewer main of any length and size,
constructed by a developer, provided the Approach sewer main meets the following
requirements:

(a) The Proposed development to be served by the Approach sewer main must be less than or
equal to one-third (1/3) of the Calculated sewer basin area to be served by the Approach sewer j
main; and
(b) The Sewer basin area to be served by the Approach sewer main shall be equal to or greater
than one thousand(1,000) acres.
(c) It is the developer's responsibility to provide all necessary information for a determination
to be made if a per acre charge is appropriate for any given construction project.
SECTION 3.
Part II of the Code of the City of Fort Worth, Texas (1986), as amended, Chapter 35, "Water

88, definition of"Developer-initiated approach water main" is hereby amended to be as follows:

Developer-initiated approach water main shall mean any approach water main constructed by
the developer with City participation, regardless of the length and size of the'pipe.

SECTION 4.

Part II of the Code of the City of Fort Worth, Texas (1986), as amended, Chapter 35, "Water and
Sewers", Article III "Charges", Division 4, "Water Main Capacity Charges", Section 35-92,
"Calculation of the water main capacity charge", subsection (3) is hereby amended to be as

follows: 1
(3) The Water main capacity charge is calculated by dividing the Development cost by
the water pipe's net capacity. The water pipe's net capacity is determined in accordance
with the most current version of the city's "Policy and Procedure for Processing Water 'I
and Wastewater Projects for Design and Construction", using a coefficient of roughness
of one hundred twenty (120). The maximum pipe capacity will be based on a pipe friction
loss of seven (7) feet per one thousand (1,000) feet length of pipe or water velocity of
seven (7) feet per second, whichever is more conservative. The net pipe capacity is equal
to the maximum pipe capacity subtracting the minimum residential fire flow. Currently
the minimum residential fire flow per Fort Worth Fire Department is 1.44 MGD, which
may change with future adoption of the International Fire Code. See a table below for net
capacity based on pipe size.

SECTION 5.
CUMULATIVE PROVISIONS

This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of
Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct

conflict with the provisions of such ordinances and such Code, in which event conflicting provisions

of such ordinances and such Code are hereby repealed.

SECTION 6.
SEVERABILITY CLAUSE
I
It is hereby declared to be the intention of the City Council that the phrase, clause, sentence,
i
I
paragraph or section of this ordinance are severable and, if any phrase, clause, sentence, paragraph
or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any
i
court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have

been enacted by the City Council without the incorporation in this ordinance of any such
P
unconstitutional phrase, clause, sentence,paragraph or section.

SECTION 7.
This ordinance shall be effective upon adoption.

Adopt Ordinance Amending Chapter 35 Water and Sewers, Article I II, Division 3, Sewer Per Acre Charges
and Division 4 Water Main Capacity Charges of the City Code to Revise the Criteria and Calculation for
Reimbursement of These Charges (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance amending Chapter 35 Water and
Sewers, Article III, Division 3, Sewer Per Acre Charges and Division 4 Water Main Capacity Charges, of I
the City Code to revise the per acre charges and water main capacity charges criteria and calculations.

DISCUSSION:
On May 14, 2002, (M&C G-13621) the City Council adopted Ordinance No. 15095 establishing sewer per
acre charges to the City Code. On June 19, 2007 (M&C G-15764), the City Council adopted Ordinance j
No. 17623 establishing water main capacity charges to the City Code. On August 7, 2012 (M&C C-25777),
the City Council adopted Ordinance No. 20317 amending Article III, Division 3 increasing the time for
collection of sewer per acre charges in certain circumstances.

For the sewer per acre charge, the current criteria for reimbursement are length of pipe of one mile and
size of pipe of 15 inches or greater. For the water main capacity charges, the current criteria for
.reimbursement are length of pipe of at least one mile and size of pipe of 16 inches or greater. This 1
amendment will remove those restrictions and allow the developer and the City to recoup the construction I
cost of the approach water and sewer mains regardless of the pipe length or pipe size for developer
initiated projects with City participation. Additionally, the amendment will also allow the fire flow demand j
to be included in the water main capacity charge by spreading that demand to all the customers that will
connect and extend from the water main. This will increase the reimbursement to the original developer
and the City that installed the pipe.

The Water Department presented these changes to the Development Advisory Committee on January 27,
2014 and February 24, 2014 and received the committee's full support for the ordinance. j

This ordinance amendment shall apply to all future sewer per acre charges and water main capacity'f
charges citywide.
