AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS FUND BY $3,207,650.00 (FROM A FUNDING
AGREEMENT WITH THE NORTH CENTRAL TEXAS COUNCIL OF
GOVERNMENTS AND THE TEXAS DEPARTMENT OF TRANSPORTATION IN
THE AMOUNT OF $2,566,120.00 WITH A $641,530.00 LOCAL CASH MATCH
PROVIDED BY SUMMER SYCAMORE I, LTD.) FOR THE SUMMER CREEK
TRANSIT-ORIENTED DEVELOPMENT SUSTAINABLE DEVELOPMENT
INFRASTRUCTURE PROJECT; PROVIDING FOR A SEVERABIL,ITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Grants Fund by $3,207,650.00 (from a funding Agreement with the North Central Texas Council of
Governments and the Texas Department of Transportation in the Amount of $2,566,120.00 with a
$641,530.00 Local Cash Match Provided by Summer Sycamore I, LTD.) for the Sumner Creek Transit-
Oriented Development Sustainable Development Infrastructure Project.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Adopt Resolution Authorizing Execution of a Funding Agreement with the North Central Texas Council of
Governments and the Texas Department of Transportation in the Amount of$2,566,120.00 with a
$641,530.00 Local Cash Match Provided by Summer Sycamore I, LTD, for the Summer Creek Transit-
Oriented Development Sustainable Development Infrastructure Project, Adopt Appropriation Ordinance
and Authorize Execution of a Development Agreement with Summer Sycamore I, LTD, for the Vertical
Construction Component of the Sustainable Development Infrastructure Project (COUNCIL DISTRICT )
RECOMMENDATION:
It is recommended that the City Council:
. Adopt the attached resolution authorizing the execution of a Funding Agreement with the
North Central Texas Council of ov rn t and the Texas Department of Transportation
in the amount of$2,566,120.00 for the Summer Creek Transit Oriented Development
Sustainable Development Project;
. Authorize the acceptance of a reimbursement rant in the amount of$2,566,120.00 from the
North Central Texas Council of Governments and the Texas Department of Transportation
to the Grants Fund;
. Authorize the acceptance of a local cash match contribution in the amount of$641,530.00 from
Summer Sycamore I, LTD, to the Grants Fund;
4. Adopt the attached appropriation ordinance increasing sti t d receipts and appropriations
in the Grants Fund in the amount of 0.00; and
. Authorize the execution of a Development Agreement with Summer Sycamore I, LTD, for
the vertical construction component of the utinl e Development Infrastructure Project.
DISCUSSION:
On September 15, 2009, the City Council nominated the Summer Creek Transit Oriented Development
( ) Sustainable Development Project for grant award Mayor and Council Communication (M&C -
1670 ) as part of the 2009/2010 North Central Texas Council of Governments ( CTCOG) Sustainable
Development call for projects. The Regional Transportation Council subsequently selected the project to
receive a grant of$2,566,120.00.
The Summer Creek TOD Sustainable Development Project includes the design and construction of
pedestrian amenities, bike trails, landscaping, and a new two-lane roadway between Sycamore School
Road and the northern boundary of the project site, along with widening Sycamore School Road from two

to four lanes west of the Chisholm Trail Parkway right-of-way to The T's station property
entrance. Pedestrian amenities include wide sidewalks, street trees, pedestrian lighting, bulb-outs for
safer pedestrian crossings, and other improvements to be designed under a context sensitive approach.
The attached exhibit illustrates project elements and locations.
The attached resolution authorizes execution of a funding Agreement with the North Central Texas
Council of Governments and the Texas Department of Transportation in the amount of$3,207,650.00,
which includes $2,566,120.00 in Regional Toll Revenue grant funds and $641,530.00 in local match funds
from Summer Sycamore I, LTD.
In accordance with the rules of the NCTCOG Sustainable Development Program, Summer Sycamore I,
LTD, will construct or cause to be constructed the required vertical construction component of the
Sustainable Development project. The City of Fort Worth will be responsible for design and construction
of the infrastructure project, as well as inspections and project management.
The project site is located near the planned Summer Creek Station on the future extension of the TEX Rail
line. The site is bounded by Summer Creek Drive on the east, Columbus Trail on the south, the Fort Worth
and Western Railroad/Planned TEX Rail Transit Corridor extension on the west and Summer Meadows
Drive on the North.
This project is located in COUNCIL DISTRICT 6, Mapsco 102M, 102H, 102G and 102L.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations,
execution of the Funding Agreement with NCTCOG and TxDOT, and adoption of the appropriation
ordinance, funds will be available in the current budget, as appropriated, of the Grants Capital Fund.
