That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Assessments Fund in the amount of $269,831.00, from available funds, fior the purpose of the construction of Altamesa Boulevard, formerly known as Dirks Road, from Chisholm Trail Parkway (SH 12 1)to Granbury Road. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflictizig provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Special Assessments Fund in the amount of$260,631.00 from developer contributions; 2. Authorize the transfer in the amount of$269,631.00 from Future Improvements in the Special Assessments Fund to the 2007 Critical Capital Projects Fund; . Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the 2007 Critical Capital Projects Fund in the amount of$269,631.00 from developer contributions; and 4. Authorize a payment for reimbursement of third-party expenses related to the easement and right-of- way Agreement with Fort Worth and Western Railroad in an amount not to exceed $269,831.00 for the construction of Altamesa Boulevard, formerly known as Dirks Road.. DISCUSSION: This project includes the construction of Altamesa Boulevard, formerly known as Dirks Road„ as a six lane divided principal arterial from Chisholm Trail Parkway (SH 121) to Granbury Road, The project also includes a new railroad bridge structure, retaining wall, sidewalk, water main adjustments, traffic signal modifications and street lights. This payment authorization is for reimbursement of third-party expenses incurred by Fort Worth and Western Railroad in connection with the construction of the project and in accordance with the provisions of the easement and right-of-way Agreement (Agreement) ( &C C-26393, City Secretary No. 44741). The third-party expenses include construction phase engineering services such as shop drawing and material data submittal review, project meetings, and inspection of railroad structural elements, as specified in the Agreement. Staff considers this fee to be fair and reasonable for the scope of services proposed to be performed.
