HomeMy WebLinkAboutOrdinance 21330-07-2014 ORDINANCE NO. 21330-07-2014 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF WEST BROADWAY AND A PORTION OF GRAINGER STREET, SITUATED IN BLOCK 36, JENNINGS SOUTH ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AND CONTAINING APPROXIMATELY 0.4378 OR 19,069 SQUARE FEET ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a variable width portion of the right-of-way of Grainger Street, a public street with variable width, lying between West Broadway Avenue on the north, and West Peter Smith Street on the south, and a five foot wide portion of the right-of-way of West Broadway Avenue, a public street with a variable width, lying between South Jennings Avenue on the east, and Grainger Street on the west, both situated in the Block 36, Jennings South Addition, an Addition to the City of Fort Worth, Tarrant County, Texas, and containing approximately 0.4378 acre or 19,069 square feet of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. Adopt the attached ordinance vacating a portion of West Broadway Avenue and a portion of Grainger Street between West Broadway Avenue and West Peter Smith Street for a new medical office building and multi-family development for Jennings and Hemphill, LLC and VGA Leasing, i and 2. DISCUSSION: Grant Engineering, Inc., on behalf of Jennings and Hemphill L C and VGA Leasing L „ has requested the vacation of portions of right-of-way to replant them with the adjoining property for a new medical office building. The City Plan Commission initially recommended approval of this request at its meeting on September 25, 2013. On January 26, 2014 the City Council remanded the requested vacation to the Urban Design Commission fortheir recommendation (MC P -3016), The Urban Design Commission recommended approval of the requested vacation to the Plan Commission and City Council at their meeting on April 17, 2014. The City Plan Commission recommended approval of requested vacation at it meeting on 6, 2014. An acceptable final plat (FS-013.•14 ) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements,. In accordance with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on March 6, 2 (M&C - 4), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets and alley. This project is located in COUNCIL DISTRICT 9, Masco 77E.
