AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITALPROJECI'S FUND IN
THE AMOUNT- OF $10,000.00, SUBJECT TO RECEIPT OF MONETARY
DONATIONS FROM FAIRMOUN'r NEIGHBORHOOD ASSOCIATION FOR THE
PURPOSE OF FUNDING THE FAIRMOUN"I'PARK COMMUNITY ID PtMLIC ART
PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMI.TLATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN 03NFLICT IIEREWITH; AND PROVIDING AN EFFECTIVE
DA17E.
BE IT ORDAFNI-0D BY THE CITY COUNCI L,OF TUE CITY OF FORT WORTH,
TEXAS.
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 20132014 in the
Budget of the City Manager, there shall also be increased estimated. receipts and appropriations in the
Specially Funded Capital Projects Fund in the amount of $10,000,00, subject to receipt of monetary
donations from Fairmount Neighborhood Association, for the purpose of funding the Fairmount Park
Community ID Public Art Project.
SECTION 2.
That should any porfion, section or part of a section of this oiAinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision,opinion or jud ent shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
proidsions shall be and remain in full for and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby,expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption,

Narrative Description
This piece, entitled "Memory- Fairmount Park,"p seeks to reveal the latent history of the park. There were
six houses that occupied the block and were removed to create the park in 1999, shortly before the
historic district was formed, The residences were an integral part of Fair°nnorrnt, and can be seen in
historic aerial photos and fire insurance maps for '75 years prior to their demolition. The only evidence of
the homes on site today is a couple rusted pipes that peals:through the soil.
"Mernor°y, Fairmount Park" is a visual reference to the historic neighborhood fabric. The addresses of the
demolished houses are demarcated along 5th and Henderson. Along Henderson, sculptural stepped
tables are located were the steps and porches of the three houses once stood. It re-establishes a
gathering space for neighbor's and visitors. Basalt gravel paths reveal the absence of walks that
approached the houses. Tree canopies provide shade,where once broad porches protected residents
and guests. The three trees provide different.color throughout the ,seasons to honor the individual

Authorize.Acceptance of a Monetary Donation from Fairmount Neighborhood Association in the Amount of

Contract with Michael Barton Shaw d/b/a Bart Shaw Architect in the Amount of$63,500.00 for Public Art
and Associated Infrastructure in Fairmount Park as Part of the Fairmount Park Community ID Public Art
Project and Adopt Appropriation Ordinance (COUNCIL DISTRICT )
RECOMMENDATION:
It is recommended that the City Council:
1, Accept a monetary donation from Fairmount Neighborhood Association in the amount of 10,000.00 for
the Fairmount Park Community ID Public Art Project;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Specially Funded Capital Projects Fund in the amount of$10,000.00 from available funds; and
3. Authorize an Artwork Commission Contract with Michael Barton Shaw d/b/a a Architect in the
amount of$63,500.00 for public art and associated infrastructure in Fairmount Park as part of the
Fairmount Park Community ID Public Art Project.
DISCUSSION:
The Artwork Commission Contract (Contract) will enable Fort Worth-based artist Michael Barton Shaw
d/b/a Bart Shaw Architect (Artist) to implement his design entitled Memory., Fairmount Park, a set ofthree
sculptural gathering tables to be located on the east side of Fairmount Park. Each table ill be comprised
of 0-foot white Conan table surface, which steps down to the ground on one end and is flanked on
either side 17-foot long wooden bench elements., The design will also include a tree at the western
terminus of ach table, providing shade where once broad porches protected residents and guests. The
three trees will also provide different color throughout the seasons to honor the individual character of the
houses that were once part of Fairmount, The Contract will also include paving fort two of the three
elements so that the artist-designed benches meet ADA accessibility standards.
The budget for the Contract is $63,500.00, which will cover all costs associated with fabricating,
transporting and installing the artwork, including any related paving, artist's fee, and other associated
miscellaneous costs.

BACKGROUND:
This project is part of the community-nominated public art initiative known as Community ID: Public Art in
Neighborhoods (CID), which is set forth in the Fort Worth Public Art Master Plan (adopted by City Council
in 2003) and the Long-Range Public Art Plan for the Water Fund. CID is an initiative of Fort Worth Public
Art through which the City assists community groups in generating public art projects that are specific and
meaningful to each of the selected neighborhoods.
The Fairmount Neighborhood Association (Fairmount NA) applied for a CID project and proposed
Fairmount Park as the site for a CID project, After a thorough review process, the Fort Worth Art
Commission approved a CID review panel's recommendation to award a CID project to the Fairmount NA.
During a planning meeting held on March 29, 2012, the Fairmount NA expressed a desire fora is -
designed benches and tables that would be site within Fairmount Park. Funding for CID projects is
typically set at $50,000.00; however, the Fairmount NA decided to donate $10,000.00 to the City to enable
the Artist to fully realize the Fairmount NA's vision for the park. Because this project will be sited on a
public park, the Parks and Community Services Department decided to allocate an additional $10,000.00
from gas well revenue proceeds, which will go towards typical park amenities such as ADA accessibility.
Artist was selected through a proposal-based selection process and placed under a Design Agreement
with the City for an amount not to exceed $5,500.00 to finalize a design, including a determination of final
artwork dimensions and submission of a detailed project budget for fabrication, transportation and
installation.
On December 12, 2014, the Fort Worth Art Commission approved the final design for this project.
The City's overall MBE goal for the Fort Worth Public Art program is 25 percent of the total capital project
dollars expended on public art annually.
This project is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION I CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, from the Specially Funded Capital Projects Fund, and from the Park Gas Well
Leases Fund.
