ORDINANCE NO. 21344-07-2014
AN ORDINANCE AMENDING CHAPTER 7 "BUILDINGS" OF
THE CODE OF THE CITY OF FORT WORTH (1986) AS
AMENDED, AMENDING ARTICLE III "INTERNATIONAL j
BUILDING CODE", SECTION 7-47 "AMENDMENTS" TO
AMEND SECTION 119, TABLE 1-B TO ADD A FEE FOR
SIMULTANEOUS PLAN AND PLAT REVIEW; PROVIDING
PENALTIES FOR THE VIOLATION THEREOF; PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN
PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE
OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE
DATE.

WHEREAS, the City of Fort Worth has heretofore enacted provisions allowing
for the plan review and inspections of construction projects and review of plats; and i
WHEREAS, the process to review plats and plans for construction process have
been separate processes with the plat review occurring first followed by the review of
construction plans; and
WHEREAS, the Development Advisory Committee, a committee appointed by
the City Manager, proposed allowing concurrent review of construction plans and plat
review to compress the time between the two reviews; and

WHEREAS, staff has accepted the proposal as a development process

improvement and upon City Council approval will allow plat and construction plan
reviews to occur concurrently; and
WHEREAS, the Fort Worth Construction and Fire Prevention Board of Appeals

recommends approval of the simultaneous plan and plat review fee to the City Council;
and

WHEREAS, the City Council has determined that it is appropriate to amend the
fee tables to include a fee for the simultaneous plan and plat review;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS,AS FOLLOWS:

SECTION 1.

Section 7-47 "Amendments" of the Code of the City of Fort Worth (1986) is
hereby amended by amending Section 119 "Fee Tables", Table No. 1-B of the Fort
Worth Building Code by adding a fee for simultaneous plan and plat review in addition to
any fees required by Table 1-C-1, to read as follows:

SECTION 2.
This article shall be cumulative of all provisions of ordinances and of the Code of
the City of Fort Worth, Texas (1986), as amended, except where the provisions of this
article are in direct conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code are hereby
repealed.

SECTION 3.
It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move,
improve, remove, convert, demolish, equip, use, occupy, or maintain any building or
structure in the City or cause the same to be done contrary to or in violation of any of the
provisions of this Code. Any person, firm or corporation violating any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof
shall be punishable by a fine not to exceed Two Thousand Dollars ($2,000.00) for all
violations involving fire safety, or public health, and sanitation and shall be fined not
more than Five Hundred Dollars ($500.00) for all other violations of this ordinance.

continues shall be deemed a separate offense and upon conviction thereof shall be
punishable as herein provided.
SECTION 4.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this ordinance are severable, and, if any
phrase, clause, sentence, paragraph, or section of this ordinance shall be declared void,
ineffective, or unconstitutional by the valid judgment or final decree of any court of
competent jurisdiction, such voidness, ineffectiveness, or unconstitutionality shall not j
affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such void, ineffective, or unconstitutional phrase,
clause, sentence, paragraph, or section.

SECTION 5.
This ordinance constitutes a digest and revision of the Building Code of the City of
Fort Worth, as provided in Section 2, Chapter XXV, and Section 9, Chapter XXVII, of i
the Charter of the City of Fort Worth. The Development Department of the City of Fort
Worth, Texas, is hereby authorized to publish this ordinance in pamphlet form for general
distribution among the public, and the operative provisions of this ordinance, as so
published, shall be admissible in evidence in all courts without further proof than the
production thereof, as provided in Chapter XXV, Section 3, of the Charter of the City of
Fort Worth, Texas.

SECTION 6.

The City Secretary of the City of Fort Worth, is hereby directed to publish the
caption, penalty clause, and effective date of this ordinance for two (2) days in the
official newspaper of the City of Fort Worth, Texas as authorized by Section 2, Chapter
XXV of the Charter of the City of Fort Worth, Texas and by Section 52:013 (a) of the
Texas Local Government Code.
SECTION 7.

This ordinance shall take effect after adoption and publication as required by law.

Adopt Ordinance Amending the Fort Worth Building Code to Add a Fee to Facilitate Simultaneous Building
Plan Review and Subdivision Plat Review (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance amending Section 7-47,
Amendments, Section 119, Fee Table No. 1-B in the Fort Worth Building Code to add a fee for
simultaneous building plan review and subdivision plat reviews.

DISCUSSION:
The Planning and Development Department has undergone several years of development process f
improvements. These improvements have been identified both internally and by the larger development
community, and are a monthly topic of discussion for the Development Advisory Committee.
The Development Advisory Committee proposed a development process improvement to allow
simultaneous review of subdivision plats and building construction plans which would allow approval of the
plans and the plat at approximately the same time. The proposed revision to the City's plat and building r
construction plan review process will save the development community time and money. i
The current process requires that the plat be completed and recorded at the County prior to submittal of

any building permit application. A finalized recorded plat would depict easements, floodplains, right-of-
way dedications, property lines and any other encumbrances on the property when the building permit
documents, inclusive of construction and site plans are initially reviewed by Staff. 'Reviewing plans prior to
plat recording may require adjustments to the construction plans as changes are made to the plat during f
the Subdivision Ordinance review process. Staff has identified five divisions within Planning and
Development, Fire and Water Departments that will need to review the same building permit information
twice, once with the initial plat submittal and a second time with the finalized plat. The additional Staff time f
spent re-reviewing building permit construction documents will necessitate assessing a $1,000.00 fee for
this new service, and may cause an increase in turnaround time for all customers. d
The Development Advisory Committee was briefed on the proposal to allow simultaneous plat and
building plan reviews at their May 19, 2014 meeting. The proposal was received with positive comments.
The Construction Fire Prevention Board of Appeals, at their June 12, 2014 meeting, voted to recommend
approval to the City Council of the amendment to the Building Code Section 119, Fee Table No. 1-B to
add a fee of$1000.00 for simultaneous plan and plat review.
If approved the new process is planned to be available to the development community on August 1, 2014.
