HomeMy WebLinkAboutOrdinance 21342-07-2014 ORDINANCE NO. 21342-07-2014 AN ORDINANCE AMENDING CHAPTER 35, "WATER AND SEWERS" OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY AMENDING ARTICLE III, DIVISION 1, "GENERALLY11, SECTION 35-58 "ASSESSMENT FRONT FOOTAGE CHARGES FOR SERVICE CONNECTION" TO ADD FRONT FOOT CHARGE RATES FOR LARGE WATER AND SEWER MAINS CONNECTING TO THE EXISTING MAINS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on June 19, 2007, the City Council adopted the Ordinance No. 17622-06-2007 amending Chapter 35, Article III, Division 1 of the City Code; and WHEREAS, the purpose of the Front Foot Charge is to allow developers and the city to recoup costs related to the construction of the water and sewer extensions; and WHEREAS, currently there is a flat rate of $38.40 per linear foot for water and $48.20 per linear foot for sewer regardless of the size of pipe connecting to the existing mains; and WHEREAS, the City Council has determined that it is necessary to apply a rate of front footage charge according to the size of pipe connecting to the existing mains. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Part II of the Code of the City of Fort Worth, Texas (1986), as amended, Chapter 35, "Water and Sewers", Article III "Charges", Division 1, "Generally", Section 35-58, "Assessment front footage charges for service connection" is hereby amended as follows: A. By amending subsection (d) subpart (5) to read as follows: (5) The director shall be authorized to collect the front foot charge in the amounts established by city council pursuant to this section and the policy for installation of community facilities, whichever is greater. B. By adding subsection (e) to read as follows: (e) Determination of the front foot charge for the appropriate pipe size. Front footage Ordinance No. 21341-07-2014 Page 1 of 3 amounts to be used to determine the front footage charge calculated in subsection (d): (1) The appropriate pipe size is determined based on the approved water and sewer studies of the subsequent developments that will benefit from the connection to the existing approach main or by the water department director's, or his designee's, approval. CUMULATIVE VISIS This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. SEVERABILITY CLAUSE It is hereby declared to be the intention of the City Council that the phrase, clause, sentence, paragraph or section of this ordinance are severable and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any Ordinance No. 21341-07-2014 Page 2 of 3 court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION . This ordinance shall be effective upon adoption. DISCUSSION: On June 1 , 2007, Mayor and Council Communication ( -157 ), the City Council adopted Ordinance No. 17622 amending the front foot charges assessment criteria and rates. Front foot charges are collected for any service connection or any extension by an adjacent property to an approach water and/or wastewater main constructed by a developer or City. These front foot charges are refunded to the developer or the City who initiated construction of the approach facility. Currently, the front footage charge is on the construction cost of a eight-inch main. That was the minimum size needed by development in the past. However, design criteria have changed for both the Water Department and the Fire Department so there are occasionally larger mains are being installed now. When a larger approach main is installed and the subsequent developer is benefiting beyond the intent of the eight-inch main, the original developer or the City is not being refunded that cost. It is necessary to add the front footage charges for large mains to properly reimburse the developer or the City based on the benefit being received. Curr nl , the front foot charge is 38.40 for water and $48.20 for sewer regardless of the size of pipe connecting. These charges will now apply to the eight-inch connecting mains or smaller. This ordinance amendment shall apply to all future water and sewer front foot charges Citywide and it is effective immediately. This project is located in ALL COUNCIL DISTRICTS.
