HomeMy WebLinkAboutContract 42246-A1 ~ CII l w.Nw AR CONTRACT N0. 1/ Z FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 42246 WHEREAS, on August 23, 2011, the City of Fort Worth ("City") and Peachtree Construction, Ltd. ("Contractor") made and entered into City Secretary Contract No. 42246 (the "Contract") for the HMAC Surface Overlay 2011-8 CDBG- Infrastructure Project/2010 Street Reconstruction Project to Reconstruct Residential Streets ("Project"); and WHEREAS, the Project is being funded with City grant monies from the United States Department of Housing and Urban Development ("HUD") through the Community Development Block Grant Program ("CDBG"), Program No.B-10-MC-48-0010, Catalog of Federal Domestic Assistance No. 14.218; and WHEREAS, the City discovered that incorrect wage determinations classified as "Heavy and Highway" were provided to the Contractor and included in Section 4 of the contract documents; and WHEREAS, City and Contractor desire to amend the contract by revising applicable certified payrolls and invoices to comply with the required prevailing wage rates. In order for this contract amount to not exceed $1,296,950.00, the scope of work may be reduced. NOW, THEREFORE, the Parties, do hereby agree as follows: I. a. Contract No. 42246, Table of Contents, Section 4, "Prevailing Wage Rates" is deleted in its entirety and replaced with the attached wage determination rates classified as "Highway" construction type. b. This amendment is effective immediately and the proper wage rate classification shall be retroactive and applied back to August 23, 2011. 11. a. All other terms and conditions of the Contract not amended herein remain unaffected and in full force and effect, are binding on the Parties and are hereby ratified by the Parties. This can he: http://wNA,w.wdol.gov/wdol/scaftles/archive/davisbacon/201 0/tx43.r 1 5/17/2012 Page 4 of 4 * an existing published wage determination * a survey underlying a wage determination * a Wage and Hour Division letter setting forth a position on a wage determination matter * a conformance (additional classification and rate) ruling On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2. ) and 3. ) should be followed. With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations.
