AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
OLD DENTON ROAD, SITUATED IN THE WILLIAM McCOWAN
SURVEY, ABSTRACT NO. 999 OF THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS; AS RECORDED IN THE DEED RECORDS
OF TARRANT COUNTY, TEXAS AND CONTAINING
APPROXIMATELY 21,837 SQUARE FEET ACRE OF LAND MORE OR
LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That portions of the right-of-way of Old Denton Road, a public street with variable width,
situated in the William McCowan Survey, Abstract No. 999 of the City of Fort Worth, Tarrant
County, Texas; as recorded in the Deed Records of Tarrant County, Texas, and containing
respectively approximately 0.481 acre or 20,973 square feet of land more or less and 0.020 acre
or 864 square feet of land more or less, and as more specifically described in Exhibits "A" and
"B" attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.

SECTION 3.
All existing utility casement be shall be retained by the City until such time all utilities
located in.that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or is of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adol)tion.

BEGINNING at a 5/8 inch iron rod with cap stamped"MY', set at the southeast corner of
Amador Drive(variable width R-O-W),conveyed to the City of Fort Worth and filed in County
Clerk's#D213218133,Deed Records of Tarrant County,Texas(D.R.T.C.T.),also being in the
existing west Right-of-Way (R-O-W) line of Old Denton Road, and also being a northeast

SUBJECT:
Adopt Ordinance Vacating Two Portions of I Denton Road to Complete a Property Exchange Between
the City of Fort Forth and AIL Investments, LP (COUNCIL DISTRICT 4)
RECOMMENDATION:
It is recommended by the City Plan Commission that the City Council adopt the attached ordinance
vacating two portions of i Denton Road and authorize the execution of documents to complete the
property exchange between the City of Fort Worth and AIL Investments„ LP.
DISCUSSION:
The City of Fort Worth, on behalf of AIL Investments,. LP, has requested the vacation of these portions of
Old Denton Road to complete a property exchange. The City Plan Commission also recommended
approval of the vacation of excess portions of Old Denton Road at its meeting on July 23, 2014. The City
Plan Commission also approved a waiver to not require submission of an acceptable plat to incorporate
this right-of way..
The Old Denton Road widening project is needed to accommodate additional traffic demands in north Fort
Worth resulting from continual growth and development. The City needs to acquire right-of-way for two
separate roundabouts on Old Denton Road at Crawford Farms Drive (0.409 acres) aand Shiver Road
(0.539 acres)„ The requested portions of Old Denton Road (0,501 acres) to be vacated are excess right-
of-way which after the realignment that the City no longer needs. (as shown on the attached exhibits)
IL Investments, LP and Hillwood Multifamily Land, LP (collectively, the Hillwood Entities) have agreed to
convey the property necessary for the Improvements to Old Denton Road. The Hillwood Entities have
requested, in return, that the Old Denton Road excess right-of-way that is adjacent to their property, when
and if it is vacated and replatted pursuant to all necessary Plan Commission, City Council, and Staff
approvals, would be conveyed to the applicable Hillwood Entities without charge for the property. The City
Council passed Mayor and Council Communication (M&C L-15690) on June 10, 2014 to approve the
property exchange for the rights-of-way and directed Staff to proceed with the execution of a property
Exchange Agreement.
This project is located in COUNCIL DISTRICT 4, Mapsco 21 U.
