AMENDMENT NUMBER TWO TO CITY SECRETARY CONTRACT NO. 42382
WHEREAS, on October 6, 2011, the City of Fort Worth ("City") and AIDS Outreach
Center, Inc. ("Contractor") made and entered into City Secretary Contract No. 42382 (the
"Contract");
WHEREAS, the Contract provided funding to Contractor pursuant to a grant received by
City from the United States Department of Housing and Urban Development ("HUD") through
the Housing Opportunities for Persons with AIDS Program, ("HOPWA") for utilization in
connection with its 2011-12 AOC HOPWA Program;
WHEREAS, Amendment Number One to City Secretary Contract No. 42382 added
language to EXHIBIT B — BUDGET to reflect the intent of the parties regarding budget details;
and
WHEREAS, AIDS Resources of Rural Texas was previously awarded HOPWA funds for
the period October 1, 2011 to September 30, 2012, but discontinued operations on September 1,
2011 and withdrew its request for HOPWA funds; and
WHEREAS, on July 24, 2011, public notice was given in the Fort Worth Star-Telegram
of a public comment period beginning July 24, 2011 and ending August 22, 2011 to receive
public comments regarding reallocating the funds awarded to AIDS Resources of Rural Texas to
Contractor; and
WHEREAS, on August 23, 2011, the Fort Worth City Council approved M&C G-17364
which authorized 1) a Substantial Amendment to the 2011-2012 Action Plan, 2) amending the
Contract with AIDS Outreach Center, and 3) extending the contract for an additional one year, if
necessary, to complete the program or achieve program goals; and
WHEREAS, City and Contractor wish to amend Exhibit B — Budget to reflect the
reallocation of funding from AIDS Resources of Rural Texas to Contractor; and
WHEREAS, it is the mutual desire of City and Contractor to amend the Contract to meet
Contract objectives.
NOW, THEREFORE, City, whose address is 1000 Throckmorton St., Fort Worth TX
76102, acting by and through Fernando Costa, its duly authorized Assistant City Manager, and
Contractor, whose address is 400 North Beach Street, Fort Worth, TX 76111-7010 acting by and
through Allan Gould, Jr., its duly authorized Executive Director, do hereby agree as follows:

The first page of EXHIBIT B — BUDGET is hereby deleted and replaced with the attached
EXHIBIT B— BUDGET (REVISED)

SUBJECT: Authorize an Amendment to the Contract with AIDS Outreach Center, Inc., to Add an
Additional $136,763.84 for a Total of$619,275.84 in 2011-2012 Housing Opportunities for
Persons with AIDS Funds and Authorize a Substantial Amendment to the 2011-2012
Action Plan (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize a Substantial Amendment to the 2011-2012 Action Plan;
2. Authorize the City Manager, or his designee, to amend the contract with AIDS Outreach Center,
Inc., to add an additional $136,763.84 for a total of$619,275.84 in 2011-2012 Housing Opportunities
for Persons with AIDS funds for services in Tarrant, Hood, Parker and Johnson Counties; and
3. Authorize the City Manager, or his designee, to extend the contract for an additional one-year term,
if necessary, to complete the program or amend, if necessary, to achieve program goals, provided
any amendment is within the scope of the program and in compliance with City policies and
applicable laws and regulations governing the use of federal grant funds.
DISCUSSION:
On August 2, 2011, City Council approved the 2011-2012 Action Plan for Federal Grant Funds
received from the United States Department of Housing and Urban Development(HUD)which
included Housing Opportunities for Persons with AIDS (HOPWA)funds. The Action Plan allocated
$136,763.84 of HOPWA funds to AIDS Resources of Rural Texas(ARRT)to serve low-income
persons living with HIV/AIDS in Tarrant, Parker, Johnson, and Hood Counties (M&C C-25066
Revised). ARRT has informed staff that it will discontinue its operations effective September 1, 2011
and so it has withdrawn its request for HOPWA funds.
AIDS Outreach Center, Inc. (AOC) has offered to assume administration of ARRT's City-funded
HOPWA program in order to ensure that existing ARRT clients do not experience a gap in
services. AOC has provided these services in the same four-county service area for over 15 years.
Staff recommends an amendment to the contract with AIDS Outreach Center, Inc., by adding the
$136,763.84 in HOPWA funds originally allocated to AIDS Resources of Rural Texas to the contract
with AIDS Outreach Center, Inc., for a total allocation of$619,275.84.
A public comment period on the transfer of these HOPWA funds was held from July 24, 2011 to
August 22, 2011. Any comments are maintained by the Housing and Economic Development
Department in accordance with federal regulations.
The program is available in ALL COUNCIL DISTRICTS.
