HomeMy WebLinkAboutOrdinance 18458-02-2009ORDINANCE NO 18458-02-2009 AN ORDINANCE VACATING, ABANDONING AND EXTINGUISHING A PORTION OF A PUBLIC ACCESS EASEMENT LOCATED WITHIN PARTS OF LOTS 36-R AND 37 R OF HICKS AIRFIELD SECTION 3, AN ADDITION TO TARRANT COUNTY TEXAS AND LOCATED WITHIN THE EXTRA TERRITORIAL JURISDICTION OF THE CITY OF FORT WORTH, TARRANT COUNTY TEXAS, AS RECORDED IN CABINET A, SLIDE 6323 OF THE DEED RECORDS, TARRANT COUNTY TEXAS AND CONTAINING APPROXIMATELY 4,000 SQUARE FEET OF LAND PROVIDING FOR REVERSION OF FEE IN SAID LAND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That a portion of a public access easement situated in Lots 36-R and 37 R in Block 5 Hicks Airfield, Section 3 an addition to Tarrant County Texas, said lots being located within the extra territorial jurisdiction of the City of Fort Worth, containing approximately 4 000 square feet of land, and as recorded m Cabinet A, Slide 6323 of the Deed Records of Tarrant County Texas, and as more specifically described m Exhibits A and `B" attached hereto and incorporated herein by reference, be and the same is vacated, abandoned and extinguished. ~' SECTION 2. That the fee to the land in the above described vacated public access easement ~s hereby released and shall revert to the adjacent owner as provided by law SECTION 3. APPROVED AS TO FORM AND LEGALITY C Assistant City Attorney Adopted and Effective• February 3, 2009 25' WIDE ACCESS EASEMENT ABANDONMENT Part of Lots 3b-R and 37 R in Block 5 HICKS AIRFIELD SECTION 3 an addition to Tarrant County Texas, recorded in Cabinet A, Slide 6323 of the Deed Records of Tarrant County said Lots 36-R and 37-R are located within the extra territorial jurisdiction of the City of Fort Worth, Tarrant County Texas, and being more pazticulazly described by metes and bounds as follows. Commencing at the common westerly corner of said Lots 36-R and 37-R and being in the easterly line of Taxiway G and the run south 32 degrees 42 minutes 28 seconds east, along the westerly line of said Lot 36-R and said easterly line of Taxiway G a distance of 25-00/100 feet to the southerly and beginning corner of 25 wide access easement to be abandoned. Thence north 32 degrees 42 minutes 28 seconds west, along the westerly line of scud Lot 36-R and said easterly line of Taxiway G to and along the westerly line of said Lot 37-R, a distance of 50-00/100 feet. Thence north 57 degrees 17 muxutes 32 seconds east, 25 feet northerly and parallel to the common line of said Lots 37-R and 36-R, a distance of 80-00/100 feet to the easterly line of said Lot 37 R and the westerly line of the tract described in the deed to Bernazd C. Williams, Jr and Van Zandt Williams, recorded in volume 7279 page 186 of the said Deed Records. Thence south 32 degrees 42 minutes 28 seconds east, along the said easterly line of Lot 37 R and the said westerly line of Williams tract, to and along the easterly line of said Lot 36-R, a distance of 50-00/100 feet. No. 18458-02-2009 DATE Tuesday February 03 2009 REFERENCE NO *PZ 2812 LOG NAME 06VA-08-030 SUBJECT Adopt Ordinance Vacating a Portion of a Public Access Easement East of Hicks Airfield Runway Containing 0 0009 Acre of Land Between Lots 36R and 37R, Block 5 Hicks Airfield Section 3 Waive the Purchase Fees RECOMMENDATION It is recommended that the City Council authorize the City Manager to 1 Adopt an ordinance vacating a portion of a public access easement 50 feet wide and 80 feet long containing 400 square feet, or 0 009 acre of land within Lots 36R and 37R, Block 5 Hicks Airfield Section 3 the City of Fort Worth Tarrant County Texas and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G- 15624) DISCUSSION Award Surveying on behalf of Warren Vanderbugh has requested to vacate the above referenced public access easement and in order to replat it with the adjoining properties The applicant plans to make this area extra room on his lots and does not want to be constrained from future development by this access easement. The City Plan Commission recommended approval of this request at its meeting on December 19 2008 An acceptable replat (FS-08-210) has been received Any existing utilities will be relocated at the applicant's expense or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon The City of Fort Worth (City) originally obtained the above mentioned easement through the platting process The City does not own land under or adjacent to the above referenced easement. Since no City funds have been expended to purchase property or easement rights collection of the fee value or any portion thereof is recommended by staff to be waived This land is located in the Extra Territorial Jurisdiction of the City of Fort Worth FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that this action will have no material effect on City funds.
