COUNTY OF TARRANT
WHEREAS, the City of Fort Worth (City) and Gutierrez, Smouse,
Wilmut & Associates, Inc. , (Engineer) made and entered into City
Secretary Contract No. 27181, (the Contract) which was authorized
by the City Council by M&C C-18798 on the 16th day of October
2001; and subsequently revised by four previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Water and Sanitary
Sewer Extension for Old Denton Road/Golden Triangle Blvd.
Area.
WHEREAS, it has become necessary to execute Amendment No. 5
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated February 19, 2004, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $5, 104 .00 .
2 .
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $221, 165.00.

3 .
All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Mr. Domenech:
This letter is our formal request for Supplemental Authorization to be compensated for
additional engineering services as requested by the City.
Justification
1. At the beginning of this project all the water and sewer lines were to be bid and
constructed together, but the City's Water Department requested that we break out the
large diameter sanitary sewer line extension on Golden Triangle Boulevard (Sewer Line
"A") so it could be included in with the improvements to be constructed by a large
development, Synergy Development, who was to be located west of Interstate Highway
35W.
2. We designed the plans to coincide with the developer's plans with respect to sheet
numbering and DOE number. We were involved with making numerous copies and
coordinated with the developer's engineer and the City personnel. We revised our
opinion of cost to split out Sewer Line "A" separately.
3. The Synergy Development was delayed. So in December 2002, we were asked by
the City's Water Department to coordinate revising our plans on Sewer Line "A" to
coincide with the new Albertson's Development plans by Bury 9 Partners cava,d

We revised two of the sheets to provide 8-inch sewer stub outs under Golden Triangle
Boulevard (GTB) where Albertson's wanted them. We were also requested to
coordinate with the Links of Alliance development on the location of our last manhole
with an 18-inch stub out for their development to the north of GTB at North Beach
Street. We were asked to revise this by the Water Department and stub out a 21-inch
pipe to the north instead of an 18-inch.
4. We made the changes, signed and sealed the plans, delivered reproducible copies
and digital copies of the plans to Bury Partners for their use with the Albertson's
Development. This first section of Sewer Line "A" on Golden Triangle Boulevard
has been built and the City approved an Amendment No. 2 to our engineering
contract to cover our additional engineering cost.
5. A company has bought one of the existing commercial tracts on Golden Triangle
Boulevard west of the North Beach Street intersection, closer to the Old Denton Road
intersection. They are requesting the City expedite installation of the west half of
proposed Sewer Line "A" so they can utilize their proposed sewer connection that they
have prepaid for.
6. The City staff has requested we separate the proposed Water Lines "A" & "C" and
Sewer Line "C" from the remaining original plans and combine it with the remaining west
half of Sewer Line "A" in a separate set of construction plans and specifications to be
advertised for bid as soon as possible.
No additional design surveying is expected and all the construction is within existing
City right-of-way for Golden Triangle Boulevard or Old Denton Road.
