Came on to be heard the above-styled and numbered cause, and came Plaintiff, City of
Fort Worth ("City"), by and through its duly authorized representative and its attorneys of
record,and came Eugene Wiley,aik/a Aubrey Eugene Wiley,Bettye Neely,Annette Wiley,a/k/a
Laura Annette Lowry, Individually, and as Independent Executrix and Trustee of the Trust
Created in the Will of Donald Bennett Wiley, Deceased (collectively the "Wiley and Neely
Defendants"), as Defendants, by and through their duly authorized representatives and attorneys
of record, and announced ready for trial. Despite proper service of the proceedings in this case,
no other Defendants have made an appearance, or they have disclaimed any interest in this
lawsuit.
I.
Prior to the commencement of trial of this cause, the parties announced that they had
agreed and reached a compromise agreement with respect to all issues between them in the case,

including the amount of damages to which the Wiley and Neely Defendants are entitled by virtue
of the condemnation of the hereinafter described property on the date said property was
condemned, said amount consisting of a total of Two Hundred Twenty-five Thousand and
No/100 Dollars($225,000.00), of which One Hundred Fifty-three Thousand One Hundred Sixty-
six and No/100 Dollars($153,166.00)was previously deposited by the City with the Court Clerk
in Denton County Probate Court, Cause No. PR2012-00291, on August 31, 2012, and the Clerk
is directed to pay such amount immediately to the order of the Wiley and Neely Defendants,c/o
William D. Tate, 1200 Main Place, Suite 1000, Grapevine, Texas, 76051-5586, 817-481-2591,
after deducting any administrative fees.
II.
It is,therefore, ORDERED,ADJUDGED AND DECREED that:
1.
By virtue of this Judgment, the City is entitled to condemn and hereby has judgment
against Defendants as sought, as described herein, and that the City have and recover a 3.627
acre permanent easement and right-of-way in, on, over, under, across, and through the property
situated in Denton County, Texas, described and depicted in the attached and incorporated
Exhibits"A"and"B,"including the right of assignment in the City, and authorizing the City,its
agents, contractors, employees, successors, designees, and assigns to enter the property as
necessary to construct, locate, operate, reconstruct, replace, repair, upgrade, perpetually
maintain, remove, and fence railroad facilities with all necessary appurtenances, apparatuses,
supporting structures, roadbed devices, and arrangements thereto, and to remove from the
property so much of the earth, stone, gravel, sand and other substances and materials as may be
reasonably necessary to construct the railroad bed, save and except oil, gas, and other minerals
and groundwater in and under and that may be produced frorr_ the property as set forth below.

The City, its agents, contractors, employees, successors, designees, and assigns shall have the
right to remove and keep removed from the permanent right-of-way easement all or part of any
building, fences, trees, shrubs, other growths or improvements which in any way endanger or
interfere with the construction, maintenance, or efficiency of the facilities. The permanent
easement may not be leased to any third party for purposes not specified herein such as cable
TV.
2.
There is reserved to the property owners all oil, gas,and other minerals and groundwater
in and under and that may be produced from the parcel described in Exhibits "A"and `B," but
the property owners,their heirs, successors,assigns and lessees shall have no right whatsoever of
ingress and egress to or from the surface of the parcel and shall not be permitted to explore,drill,
mine,or produce oil, gas or other minerals, or groundwater, from the surface of the parcel. The
property owners will be permitted to extract such minerals and groundwater from the parcel
described in Exhibits "A" and "B"by directional drilling and other means, so long as the City's
use of said parcel is not disturbed and the lateral and subsurface support for the City's facilities is
not adversely affected. If the mineral estate is subject to existing production or an existing lease,
this reservation includes the production,the lease and all benefits from it.
3.
The property owners shall have the right to cross over and/or under the property
described in Exhibits "A" and "B" with utilities; provided, however, the property owners, their
successors in interest, or the utilities, shall not interfere with the City's use of the property and
shall be required to comply with the procedures as provided in Exhibit"C" attached hereto and
made a part hereof for granting utility crossings of rail lines, including meeting minimum

clearance standards for utility lines and minimum depth standards for utility pipelines and
conduits.
The property owners shall have the right to pipe water across and under the property
pursuant to the terms provided in Exhibit"D"attached hereto and made a part hereof, so long as
such activity does not interfere with the City's use of the property, for the purpose of piping
water from one portion of the property owners' land to the other.
4.
The Notice of Lis Pendens filed on April 10,2012 by the City and recorded at Instrument
#2012-36542, Official Public Records of Denton County, Texas, is hereby released and
cancelled.
5.
The Clerk of this Court record this Judgment in the minutes of this Court.
6.
The costs of this proceeding shall be paid by the City, which costs shall be paid to the
County Clerk of Denton County,Texas.
7.
All relief requested by any party in this case and not granted in this Final Agreed
Judgment is denied. This is a final judgment and disposes of all issues and parties in this case.

its property with which the Electric Supply Line will in any way imerfere, including the

(90)days after receiving written notice from Santa Fe to such effect,make such changes in the

harmless Licensor for all losses, damages, injuries or death to any
person, as well as expenses, arising in any manner out of the failure-of

(c) All insurance shall be placed with insurance companies licensed to do
business in the State in which the Electric Supply Line is located, with
a current Best's Insurance Guide Rating of B and Class X, or better. dot(
Licensee,,shah plovtde Licensor in advance of said installation and
maintenance periods a Certificate of Insurance evidencing such
insurance. Insurance must provide for coverage of incidents occurring
within fifty (54) feet of a railroad track, and any provision in the
insurance policy to the contrary must be specifically deleted.
(d) The furnishing of insurance required by this Section 8 shall in no way
limit or diminish the liability or responsibility of Licensee as provided
under any Section of this Lio se.
9. (a) Licensee shall comply with all federal, state and focal environmental
laws and regulations in its use of Licensor's property,including,but not
limited to, the Resource Conservation and Recovery Act, as amended
(RCRA), and the Comprdensive Environmental Response,
Compensation, and Liability Act, as amended (CERCLA). Lie see
shall not release or suffer the release of hazardous substances,as defined
by CERC'IA, on Tjowsor's property. Notwithstanding any other
requirements in this contract,Licensee assumes all responsibility for the

(c) In the event that Licensor receives notice from Licensee or otherwise of
I release or violation of environmental laws which o=red or is
occurring during the term of this License, Licensor may ra411im

violation.

10, Upon written notice from Licensor, Licensee agrees to assume the defense of
any lawsuit, or other proceeding brought against Licensor by any public body, individual,
parmemWp, corporation,or other legal entity,relating to any matter covered by this License for
which Licensee has an obligation to assume liability for andlor save and hold harmless Licensor ��a
Licensee shall pay all the costs incident to such defense including,but not limited togs r F;
fees, investigators' fees, litigation expanses, settlement payments, and amounts paid in
satisfaction of judgments.
11. Since this license is made in part for the benefit of other companies operating (
over Santa Fe's tracks,any of said companies may sue to enforce the provisions hereof,either �yN
jointly or severally, as their interests may be joint or several.

12. If default shall be made in any of the covenants or agreements of Licensee
contained in this document,or is case of any assignment or transfer of this License by operation
of law, Licensor may, at its option, terminate this Licernse by serving five(5) days' notice in
writing upon Licensees but any waiver by Licensor of any default or defaults shall not constitute
a waiver of the right to oerminarc this Lausrase for any subsequent defattlt or defaults,nor shall

RECOMMENDATION:
It is recommended that the City Council approve the settlement of all claims arising from the eminent
domain lawsuit the City filed to acquire property interests for the Alliance Airport Runway Extension
Project in the amount of$225,000.00, plus closing costs not to exceed the amount of$5,000.00.
DISCUSSION:
The City authorized condemnation proceedings against the Wileys to acquire a 3.627 acre tract to be used
in connection with the Alliance Airport Runway Extension Project. The property is located near the
intersection of State Highway 156 and Sam Reynolds Road. The property will be used for the relocation
of the Burlington Northern Santa Fe (BNSF) Main Line and Connector Track. This relocation is necessary
to accommodate the runway extension at Alliance Airport. The parties have agreed that $225,000.00 is
fair compensation. Closing costs will not exceed the amount of$5,000.00. The Federal Aviation
Administration is funding the purchase of properties for this project through grants.
This project is located in COUNCIL DISTRICT 7.

The Financial Management Services Director certifies that upon approval of the above recommendations,
funds are available in the current capital budget, as appropriated, in the Airport Grants Fund.
