BRADSHAW AND ROBERT NEEL MCDONA D; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDIN A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING N EFFECTIVE DATE I WHEREAS, Section 30.00006 (h) of the Texas Government Code provides that the governing body of the municipality shall determine the salary of the municipal judges; i WHEREAS, Section 10-2 of the City Code states that the Ad Hoc Municipal Curt I Advisory Committee shall make recommendations to the city council on all matters relating to i the municipal court judges; and WHEREAS, the Ad Hoc Municipal Court Advisory Committee recommended that the a pay for Andrew T. Bradshaw and Robert Neel McDonald be adjusted to be commensurate th other Municipal Judges who have completed five years of continuous service. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, AS FOLLOWS: SECTION 1. That Municipal Court Judges Andrew T. Bradshaw and Robert Neel McDonald, ho I have completed five years of continuous service, receive a pay rate adjustment, with a new pay i rate set at $47.23 per hour effective August 23, 2014. i I SECTION 2. ; This ordinance shall be cumulative of all provisions of ordinances and of the Code o the City of Fort Worth, Texas (1986), as amended, except where provisions of this ordinance are in i I II i Ordinance No.21390-08-201 Page 1 of I i i i direct conflict with the provisions of such ordinances and Code, in which event such conflicting i provisions of such ordinances and Code are hereby repealed. SECTION 3. f It is hereby declared to be the intention of the City Council that the sections, paragral hs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clat se, sentence, paragraph or section of this ordinance shall be declared void, ineffective or I unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, si ich i ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, claw,es, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by r the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence,paragraph or section. i I SECTION 4. Bradshaw and Robert Neel McDonald Effective August 23, 2014 (ALL COUNCIL DISTRICTS) I RECOMMENDATION: It is recommended that the City Council adopt the attached ordinance establishing a pay rate adjustment for Municipal Judges Andrew T. Bradshaw and Robert Neel McDonald to be effective August 23, 2014 I DISCUSSION: I On July 14, 2014, the Ad Hoc Municipal Court Advisory Committee considered a pay rate adjustment for Municipal Court Judges Andrew T. Bradshaw and Robert Neel McDonald. Both of these judges ave completed five years of continuous service and the Committee was asked to consider a recommendation to adjust their pay rate so it would be at the same level of pay as the other sitting associate Municipal Judges with over five years of service. The Committee voted unanimously to recommend the pay rate adjustment. The new pay rate for Judges Bradshaw and McDonald is to be set at $47.23 per hour and is to become effective on August 23, 2014. Since the purpose of this increase is to provide parity among the Municipal Judges of comparable seniority, the Human Resource Department will process this adjustment prior tc the implementation of the across-the-board pay increase approved by the City Council on August 12, 2014 (Resolution 4344-08-2014), which will apply to all of the Municipal Judge positions. I Total estimated salary/benefit cost for each position for the remainder of the Fiscal Year 2013-2014 is 1 $564.26 for a total estimated amount of$1,128.52. ; FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that funds were not specifically budgeted for this purpose; however, Municipal Court is projected to be under budget for Fiscal Year 2014.
