AN ORDINANCE AMENDING CHAPTER 22 "MOTOR VEHICLES AND i TRAFFIC," ARTICLE VI "STOPPING, STANDING AND PARKING," DIVISION 2 "PARKING METERS," OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986), AS AMENDED, BY AMENDING SECTION 22-192 "HOURS METERS TO OPERATE; INFORMATION TO BE SHOWN ON METERS" TO DESIGNATE VETERANS DAY AS A PARKING METER HOLIDAY AND DELETE WASHINGTON'S BIRTHDAY AS A PARKING METER HOLIDAY; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEAL CONFLICTING ORDINANCES; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth ("City Council") seeks to protect the public safety,preserve the quality of life, and promote efficiency within the City; and I WHEREAS, the City Council seeks to honor the service of United States Armed Forces ll' veterans by designating Veterans Day as a parking meter holiday so that the public can use City I parking meters at no charge to attend events on Veterans Day; and Ij WHEREAS, there is no history of any large events associated with the celebration of V' Washington's Birthday that make it necessary to continue the designation of that day as a parking meter holiday; I WHEREAS, it is advisable to amend Chapter 22 of the Fort Worth Code of Ordinances j to designate Veterans Day as a parking meter holiday and delete Washington's Birthday as a parking meter holiday; and WHEREAS,the City Council finds this Ordinance to be reasonable and necessary; i NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS,THAT: SECTION 1. Chapter 22 "Motor Vehicles and Traffic," Article VI "Stopping, Standing and Parking," Division 2 "Parking Meters," Section 22-192(b) is hereby amended to designate Veterans Day as a parking meter holiday and delete Washington's Birthday as a parking meter holiday and read as follows: (b) Except within the Cultural District, in addition to Saturdays and Sundays, the following parking meter holidays will be observed: (1) New Year's Day—January first. i f (2) Martin Luther King Jr.'s Birthday—Third Monday in January. (3) Veteran's Day—November eleventh. (4) Memorial Day—Last Monday in May. (5) Independence Day—July fourth. (6) Labor Day—First Monday in September. (7) Thanksgiving Day—Fourth Thursday in November. (8) Thanksgiving Friday-Friday after the Fourth Thursday in November. i (9) Christmas Day—December twenty-fifth. I SECTION 2. j This ordinance shall be cumulative of all provisions of ordinances of the Code of the City of Fort Worth, Texas, (1986), as amended, except where the provisions of this ordinance are in direct ' conflict with the provisions of such ordinances and such Code, in which event conflicting provisions i of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid I judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase,clause, sentence,paragraph or section. 4 SECTION 4. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of the Code of the City of Fort Worth, or any other ordinances of the City, that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance, but may be prosecuted until final disposition by the courts. SECTION 5. All other provisions of Chapter 22 of the Code of the City of Fort Worth, as amended, shall remain in full force and effect, save and except as amended by this ordinance. It is recommended that the City Council adopt the attached ordinance amending Chapter 22 Motor Vehicles and Traffic, Article VI Stopping, Standing and Parking, Division 2 Parking Meters, Section 22-192 (b)(3) of the Code of the City of Fort Worth to designate Veterans Day as a parking meter holiday and delete Washington's Birthday as a parking meter holiday. d I DISCUSSION: i Chapter 22, Article VI, Division 2, Section 22-192(b) designates the parking meter holidays for the City of f Fort Worth. On these designated parking meter holidays, the public is allowed to use parking meters at no charge. Veterans Day is currently not included as a designated parking meter holiday for the City of Fort Worth; however, Veterans Day is a federal holiday. Last year on Veterans Day, Monday, November 11, 2013, a number of people attending the Veterans Day parade in the Fort Worth Central Business District (CBD) assumed that Veterans Day was a parking meter holiday and parked in metered spaces without paying the meter. Subsequently, many of the people received parking citations. On Veterans Day there are a number of City-wide events scheduled to honor the service of United States Armed Forces veterans. The largest event is the Tarrant County Veterans Day Parade in the Central j Business District (CBD). Veterans Day observance is a large event annually with an anticipated if attendance to exceed 15,000 people, including spectators, parade participants, volunteers, veterans and over 3,500 Reserve Officers Training Corps members. There is no history of any large events associated with the celebration of Washington's Birthday; thus, the designation of that day as a parking meter holiday for the City of Fort Worth is no longer necessary. i Adoption of this ordinance will designate Veterans Day as a parking meter holiday for the City of Fort Worth, which will allow the public to attend numerous Veterans Day events without paying for parking j meters. Additionally, adoption of this ordinance will delete Washington's Birthday as a parking meter holiday for the City of Fort Worth. To estimate the fiscal impact of the proposed parking meter holiday change, data was collected and analyzed for the past three years for the months of February and November. These are the months for i celebrating Washington's Birthday and Veterans Day respectively. For the months of February 2012- Logname: 20PARKING ON VETERANS DAY Pagel of 2 i 2014, the daily revenue average was $6,826.42. For the months of November 2011 through 2013 the i daily revenue average was $7,035.48. Based on these averages and the assumption that an average day j in either month over the time period reviewed is representative of the amount that would be made on those holidays, then moving the parking meter holiday from Washington's Birthday to Veterans Day yields i a net loss of only $209.06, which is roughly 3.0 percent of parking meter revenue for one day. i The fiscal impact of changing the parking meter holiday from Washington's Birthday to Veterans Day is an I estimated loss of less than $250.00. i FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that the estimated loss is less than $250.00.
