AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF
AUTHORIZED SWORN POSITIONS IN THE POLICE DEPARTMENT
BY ADDING TEN POSITIONS IN THE CLASSIFICATION OF
OFFICER; PROVIDING A STATEMENT OF PURPOSE AND INTENT;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF
ALL PRIOR ORDINANCES AND REPEAL CONFLICTING
ORDINANCES; _ PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 143.021(a), Texas Local Government Code provides that a
municipality's governing body shall by ordinance (i) establish the classifications of police
officers and (ii) prescribe the number of positions in each classification; and
WHEREAS, on September 24, 2013, the City Council adopted Ordinance 20958-
09-2013, which established the Police Department's sworn personnel staffing levels,
effective October 1, 2013, as follows:

WHEREAS, the Police Chief has requested that the City Council increase the
number of authorized positions within existing classification of Police Officer by ten (10)
to accommodate all graduates of the current academy class, and thereafter prescribe the
number of authorized positions in the Police Department to conform with the proposed
changes as set forth below in order to effect efficient economy of the operations of the
Police Department.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH,TEXAS:
SECTION 1.
That, following the formal adoption of this ordinance, the following positions
shall be the only sworn positions in each classification (rank) authorized in the City of
Fort Worth Police Department effective May 31, 2014, until modified by subsequent
ordinance:

SECTION 2.
The "Mayor and Council Communication" memorandum, which is presented
contemporaneously with this ordinance, is hereby expressly incorporated herein by
reference for further clarification and explanation of the purpose and intent of the City
Council in its adoption of this ordinance as well as the Department in its implementation.
SECTION 3.
This ordinance shall be cumulative of all provisions of previous ordinances and of
the Code of the City of Fort Worth, Texas (1986), as amended, except where the
provisions of this ordinance are in direct conflict with the provisions of prior police

staffing ordinances for the Police Department and such Code, in which event conflicting
provisions of such ordinances and such code provisions are hereby repealed and this
ordinance shall be controlling.
SECTION 4.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of these ordinances are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional
by the valid judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence,paragraph or section.
SECTION 5.
This ordinance shall take effect on May 31, 2014

Adopt Ordinance Increasing the Number of Authorized Positions in the Classification of Police Officer in the
Police Department by Ten, Thereby Increasing the Total Number of Authorized Civil Service Positions by
Ten (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance prescribing the number of
authorized sworn positions in each classification in the Police Department effective May 31, 2014,
increasing the number of authorized positions in the classification of Police Officer by ten, thereby
increasing the total of authorized civil service positions from 1549 to 1559.
DISCUSSION:
The purpose of this Mayor and Council Communication and the attached ordinance is to increase the
number of authorized positions in the classification of Police Officer in the Police Department by ten,
effective May 31, 2014, so that the Fort Worth Police Department (FWPD) will be able to commission all of
the graduating recruits in police academy Class 135 as Police Officers.
The FWPD currently is training 38 recruits in Class 135, who are expected to graduate on May 30, 2014
and be eligible to be commissioned on May 31, 2014. As a result of attrition, retirements, and internal
promotions, the FWPD will have 28 vacancies in the Police Officer classification by the time the new class
of officers is commissioned. In order to commission all 38 graduates of Class 135, ten additional positions
in the Police Officer classification are needed. Addition of these positions would increase the number of
authorized positions in the classification of Police Officer from 1103 to 1113 and increase the overall total
of authorized civil service positions in the Police Department from 1549 to 1559.
Because of retirements and other types of separation from employment, FWPD continually has vacancies
arise, yet the recruit classes graduate approximately every seven months. The FWPD attempts to fill each
vacancy with the graduates of the academy, but often there are more vacant positions than graduates to
fill them. The consequence of additional vacancies is that the City has less patrol officers to respond to
calls for service. Therefore, in an effort to keep the number of vacancies as close to zero as reasonably
possible, FWPD plans its training academy class sizes in order to, as closely as possible, approximate the
number of known and projected vacancies.
In this instance, the number of vacancies in the Police Officer at the time of graduation will not be
sufficient to cover the entire class of graduating recruits. Therefore this request seeks to temporarily
increase the number of authorized positions in the classifications of Police Officer in order to
accommodate all of the graduates. Following the commissioning of these officers, as new vacancies
occur, whether through attrition or promotion, the FWPD will hold Police Officer positions vacant to offset
the requested increase and expects to submit an updated staffing ordinance to City Council in
approximately three months to reduce the number of authorized positions back to the currently authorized

number of 1549.
In preparing its Fiscal Year 2014 budget the FWPD took into account projected unfilled vacancies and
associated salary savings with the intent to use cost savings and vacancies to field and pay for the recruits
of Class 135. However, enhanced compensation required by the Meet and Confer Agreement and lower-
than-projected salary savings mean that the FWPD has not yet been able to identify sufficient funding and
savings to cover the full cost of all of the positions associated with the graduates of Class 135. The
FWPD will continue to work with the Financial Management Services Department and to review the
department's budget and expenditures to identify additional savings that will be used to offset these costs.
On September 24, 2013, the City Council adopted its most recent authorized staffing ordinance for the
Police Department(Ordinance No. 20958-09-2013), which decreased the total number of authorized
positions to 1,549, effective October 1, 2013. Approval of the attached ordinance would result in new
authorized staffing levels as follows, to be effective May 31, 2014
