HomeMy WebLinkAboutOrdinance 21362-08-2014 ORDINANCE NO.21362-08-2014 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $3,026,007.00, FOR THE PURPOSES OF EXECUTING A LOCAL PROJECT ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR A TRANSPORTATION ENHANCEMENT PROGRAM,TRINITY TRAILS CLEAR FORK, EAST BANK EXTENSION PROJECT; PROVIDING FOR A SEVERABIL,ITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $3,026,007.00, for the purposes of executing a Local Project Advance Funding Agreement with the Texas Department of Transportation for a Transportation Enhancement Program- Trinity Trails Clear Fork-East Bank Extension Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached resolution authorizing the City Manager to execute a Local Project Advance Funding Agreement with the Texas Department of Transportation for a Transportation Enhancement Program - Trinity Trails Clear Fork- East Bank Extension Project in the amount of$3,026,007.00 with local participation in the amount of$870,007.00; 2. Authorize the acceptance in the amount of$2,156,000.00 in federal funds contributing to the Transportation Enhancement Program Neighborhood Transportation Connections for Pedestrians and Bicycles Project through Texas Department of Transportation; 3. Authorize the transfer of$870,007.00 from the SH121T Southwest Parkway Fund to the Grant Fund towards the City's match: 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$3,026,007.00; and 5. Authorize an initial payment to Texas Department of Transportation in the amount of$92,981.00 for direct state costs in accordance to the Agreement. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt a Resolution authorizing the City Manager to execute a Local Project Advance Funding Agreement (LPAFA) with the Texas Department of Transportation (TxDOT). The LPAFA details the responsibilities of both the City and TxDOT in the development of the project. This M&C also authorizes acceptance of federal grant funds, transfer of funds to serve as the City's match and adoption of the appropriation ordinance for the project. TxDOT issued a Call-for-Projects on October 12, 2012, under the federal Transportation Enhancement (TE) Program. The TE Program is unique in that it emphasizes the development of non-traditional transportation projects. This is an 80 percent federally funded cost-reimbursement program with a Logname: 802012 STEP AFA EAST BANK TRAIL Page 1 of 2 minimum 20 percent local match. On November 12, 2012, (M&C G-17737) the City Council authorized the City Manager to submit an application for funding for the Neighborhood Transportation Connections for Pedestrian and Bicycles Project. On July 26, 2013, TxDOT notified the City of Fort Worth that the Trinity Trails Clear Fork- East Bank Extension Project was selected for funding. The Trinity Trails Clear Fork- East Bank Extension provides an off-street trail connection from the Mistletoe Heights neighborhood north to a new on-street trailhead at Parkview Drive. The ultimate goal is to continue this trail to the north to the newly constructed Rotary Trailhead on the east bank of the Trinity River where it connects with the Phyllis Tilley Memorial Bridge. Additionally, this connection will create off-street access to Parkview Drive. This connection will also provide access to a future barrier separated bike lane on the Vickery bridge which is being constructed as part of the Chisholm Trail Parkway. This trail extension was included in the Trinity River Vision Neighborhood and Recreation Enhancement Plan which was adopted by City Council on August 4, 2009 (M&C G-16638). The local match in the amount of$870,007.00 will be allocated from the 2004 Capital Improvement Program for the Chisholm Trail Parkway, programmed as part of the original project scope for enhancements to the Trinity River corridor in the vicinity of the Chisholm Trail Parkway. This project is located in COUNCIL DISTRICT 9.
