• AMENDMENT NO. 4 STATE OF TEXAS S CITY SECRETARY CONTRACT NO.� -A4 (MSC Required) COUN'T'Y OF TARRANT S WHEREAS, the City of Fort Worth (City) and Kimley-Horn and Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 29706, (the Contract) which was authorized by the City Council by M&C C-20000 on the 23th day of March 2004 and subsequently revised by three previous amendments ; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract LXX (70) . WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I , of the Contract is amended to include the additional engineering services specified in M&C C-23279, adopted by the City Council on the 13th day of January 2009, and further amplified in a proposal letter dated October 22, 2008, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed. by Engineer total $117,742 .00. 2 . Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the gum of $695,017 .00. Authorize the transfer of$125,742.00 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of $92,410.00 and Sewer Capital Projects Fund in the amount of $33,332.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$92,410.00 and the Sewer Capital Projects Fund in the amount of$33,332.00, from available funds; and 3. Authorize the City Manager to execute Amendment No. 4 in the amount of$117,742.00 to City Secretary Contract No. 29706 with Kimley-Horn and Associates, Inc., for additional engineering services thereby increasing the contract amount to $695,017.00. DISCUSSION: On March 23, 2004, (M&C C-20000) the City Council authorized the City Manager to execute an Engineering Agreement (Agreement), with Kimley-Hom and Associates, Inc., in the amount of $408,450.00 for the design of Sanitary Sewer Rehabilitation Contract LXX (70). The agreement was subsequently revised by three amendments totaling $168,825.00 as follows: . Amendment No. 1 (M&C C-20334, October 12, 2004) in the amount of $62,629.50, provided for the necessary design to relocate an existing 30 inch sanitary sewer main to accommodate proposed rail line extension by Union Pacific Railroad at its Centennial rail yard facility as well as the rehabilitation of a sewer main located immediately downstream of the 30 inch sewer main; . Amendment No. 2 (M&C C-20486, January 1, 2005) in the amount of $39,935.50, provided for the necessary design to replace a severely deteriorated segment of sanitary sewer M- 199R* located underneath the runway of the Naval Air Force Station (NAS) Fort Worth Joint Reserve Base; . Amendment No. 3 (M&C C-21208. December 20, 2005) in the amount of $66,260.00 required the resurvey and redesign of sanitary sewer improvements that were proposed within the Union Pacific Railroad Yard due to significant changes in topography by the railroad company. Amendment No. 4 will provide for the following: . The relocation of sewer lateral L-2333 from private property between Tulsa Way and Camp Bowie Boulevard at the intersection with Montgomery Boulevard to public right-of-way on http://apps.cfwnet.org/cauncil_packet/mc review.asp?ID=10795&counciIdate=1/]3/2009 1/14/2009 M&C Review Tulsa Way; . The replacement of the severely deteriorated water mains on Monticello Drive (River Crest Drive to Hamilton Avenue), Potomac Avenue (Virginia Place and West 4th Street) and Williamsburg Lane (Bristol Road to Bailey Avenue); • Additional traffic control design on the project; and . Additional design survey and easement preparation on the project. Kimley-Horn and Associates, Inc., proposes to perform the necessary additional design work for a lump sum fee of$117,742.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount $8,000.00 (water: $5,000.00 and sewer: $3,000.00) is required for utility coordination and real property acquisition. M/WBE: Kimley-Horn and Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to 38 percent M/WBE participation for this Amendment No. 4. The City's goal on this amendment is 20 percent. This project is located in COUNCIL DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Financial Management Services Director certifies that upon approval and completion of the above recommendations and the adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Water and Sewer Capital Projects Funds. Parts of the Tulsa Way Townhomes and Camp Bowie Office Building are to be constructed on top of the 6-inch sanitary sewer L-2333. The City of Fort Worth (City) has instructed Kimley-Horn to perform design services to relocate L-2333, abandon the existing L-2333 that will be under the proposed facilities, and provide new service laterals for the affected facilities as shown in Alignment Exhibit E1. In addition, the City has informed Kimley-Horn of several water line breaks that have been reported. These line breaks include the 8-inch water line located along Monticello Dr. between River Crest Dr. and Hamilton Ave., the 6/8-inch water lines located along Potomac Ave. between Virginia Pl. and West 4`h St., and the 6-inch water line located along Williamsburg Ln. between Bristol Rd. and Bailey Ave (See Alignment Exhibit 2). The City has instructed Kimley-Horn to perform design services to replace these water lines and re-connect affected services. Starting in April of this year, the City requested we begin providing a monthly progress report and attend a monthly progress meeting as part of the City's ongoing Sanitary Sewer Overflow (SSO) program, initiated by TCEQ for this project. The City has requested Kimley-Horn to prepare the work described above as part of the Sanitary Sewer Rehabilitation Contract LXX (70). Mr. Liam Conlon,October 22,2008,Page 3 Detailed Scope of Services and Associated Fees The scope of services associated with each item is as follows: Item I (Relocation of 6"Sanitary Sewer L-2333): $8,300 Kimley-Horn $1,000 Kimley-Horn (Traffic Control) $8,400 Survey and Easements $ 840 10% Subconsultant fee $18,540 Total (Water$0, Sewer $18,540) • Task 1 -Routing and alignment based on the lines identified in Alignment Exhibit El for the proposed sanitary sewer improvements. $3,500 o Collect data of record drawings of City and franchise utilities located near the proposed alignment. o Review data and compare to field observations. o Prepare an exhibit containing existing conditions and showing the recommended alignment of the sanitary sewer and easement on an aerial map and City block map. • Task 2 - Survey, Level B SUE for sewer service locates, and easement preparation and for the proposed sanitary sewer improvements as shown on Alignment Exhibit E1. $8,400 o Survey along proposed alignment will include: ■ Establish horizontal and vertical control for the project area. ■ Property Ownership Research ■ Topographic Survey of approximately 600 LF along the proposed sanitary sewer route. o Prepare easement documents for the section of line that will be located along private property (1 permanent, 1 temporary). • Task 3 - Prepare a preliminary design for the proposed 8-inch sanitary sewer. The preliminary design will include an opinion of probable construction cost and schedule for bidding, award and construction of approximately 600 LF of improvements. $2,500 • Task 4 - Final design services for the proposed sanitary sewer improvements. $2,300 o After City approval of the preliminary design described in Task 2, Kimley-Horn will prepare final design for approximately 600 LF of relocation of 8-inch sanitary sewer. The amount we will be subcontracting is $44,220. This represents an M/WBE participation percentage of 38% for these additional services. With these Additional Services, our revised contract amount will be $695,017. This will revise our total contract M/WBE participation from $146,030 (25.3%) to 190,250 (27.3%).
